L'examen revèle cependant qu'en dépit de quelques concessions à la logique dont ces schémas procèdent, elle ne s'y réduit pas. L'obligation solidaire existe, autonome. Mais elle puise sa substance dans une notion qui est traditionnellement tenue pour son antithèse. Elle n'est en effet rien d'autre qu'une obligation conjointe soustraite à la division que, pour des raisons historiquement claires mais théoriquement obscures, le droit positif français fait en principe subir à cette obligation.
