La prescription acquisitive, dit-on, a pour fondement la présomption que celui qui jouit d'un droit, qui le possède, en a été réellement investi par _une juste conse_d'a0quisition; on ne l'eût pas laissé jouir si longtemps et si paisiblement, si la possession 'n'eût été qu'une usurpation. Il est facile de répondre, et la ré ponse est péremptoire. Cela peut se dire de l'usucapion par dix et vingt ans mais la prescription acquisitive de trente ans ne suppose ni titre ni bonne foi; celui qui l'invoquo peut avouer qu'il est un usurpateur, et néanmoins il sera propriétaire en vertu de sa longue possession et quoiqu'il n'ait jamais ou une juste cause d'acquisition. La prétendue présomption n'est donc que l'un des motifs que l'on peut invoquer à l'appui de la prescription; à lui seul, il ne la justifie pas; ce qui ruine la base de l'innovation que nous combattons. The initiative towards the preparation of this volume in tribute to Wolfgang Friedmann was taken by his colleague, Hans Smit, of Columbia University, who also arranged for its publication. Judge Philip C. Jessup was the chairman, and Professors John N. Hazard, Louis Henkin, Oliver Lissitzyn, Willis L. M. Reese and Hans Smit of Columbia University Law School, A. A. Fatouros of Indiana University Law School (Bloomington), and Gabriel M. Wilner of the University of Georgia Law School were members of the editorial committee. The authors of the essays are a group of distinguished legal scholars from many countries and who hold widely diverse views. All of them had many ties with Professor Friedmann, including those of friendship and shared interest in problems that were of the greatest concern to him.
