La catégorie des intermédiaires autonomes n'est pas homogène puisque certains ont le statut de commerçant tandis que d'autres sont de simples mandataires. En ce qui concerne les intermédiaires commerçants, il n'y a entre les droits français et mexicains aucune différence essentielle. En ce qui concerne les simples mandataires, le droit mexicain est resté largement fidèle à la doctrine de l'autonomie de la volonté tandis que le droit français applique au mandat un certain nombre de règles qui limitent la volonté des parties. Les droits français et mexicain s'efforcent de renforcer l'autonomie du mandataire soit en appliquant la notion de mandat d'intérêt commun et en prévoyant le paiement au mandataire d'une indemnité en cas de rupture du contrat, c'est le cas en France, soit en associant le mandataire au bénéfice et aux pertes des affaires qu'il traite, c'est le cas au Mexique. La catégorie des intermédiaires en état de subordination regroupe toutes les personnes, salariées ou non salariées que le droit social protège. En France, le droit social s'applique non seulement aux salariés mais aussi à certaines catégories de mandataires fortement dépendants du fournisseur qui cumulent alors les avantages du mandat et du droit social. Au Mexique, le droit social s'applique aux salariés et la loi permet à tous les travailleurs non salariés de s'affilier, à leur frais, au régime obligatoire de la sécurité sociale afin de bénéficier de certaines de ses prestations.

Son activité est soumise le plus souvent aux règles du mandat. Le mandant a en général un pouvoir contractuel supérieur à celui de son mandataire auquel il réussit à imposer souvent des clauses défavorables. C'est pourquoi dans de nombreux pays modernes, le législateur est intervenu pour réglementer le contrat de représentation et accorder aux agents commerciaux un statut protecteur. De vastes réflexions sur la circulation du modèle juridique français ont été menées. Or, le code napoléonien de 1804 constitue encore aujourd'hui au Proche Orient la référence et la base du droit. Ceci est particulièrement vrai en Syrie. Si certains pays du Proche-Orient (par ex, Liban et Egypte) ont doté leurs agents d'un statut qui reprend assez exactement les termes du décret français du 23 décembre 1958 et la loi du 25 juin 1991, d'autre côté il existe bien entendu de nombreux pays où les agents commerciaux ne bénéficient d'aucun texte particulier et c'est le cas de la Syrie. Il est donc utile de comparer entre ces pays pour savoir la possibilité d'accorder aux agents commerciaux, en Syrie, un statut protecteur en s'inspirant du modèle français. L'apparition du statut des agents commerciaux a posé de nombreux problèmes de délimitation et de cumul avec les différentes catégories d'intermédiaires dont la qualification juridique peut soulever des difficultés. Ainsi que, de déterminer la nature juridique de son mandat et la question de droit de l'agent commercial à l'indemnité de rupture et son droit à la commission. Cette étude expose d'une part, les caractéristiques essentielles de l'agent commercial, la nature juridique de son mandat et une comparaison avec les contrats voisins, d'autre part, aborde la protection accordée à l'agent en France et dans les pays du Proche-Orient. Cette protection se traduit en deux importantes questions : assurer d'une part, son droit à l'indemnité en limitant les tentations de mettre fin au contrat de l'agence pour le mandant, et d'autre part, la rentabilité de son activité en réglementant son droit à la commission.
