Plus généralement lorsqu'on applique les normes pénales aux infractions entre mineurs, il apparaît que le législateur a posé une présomption de consentement entre mineurs. Cette présomption ne se justifie pas à différents égards. De même, l'application du droit pénal à ces infractions entraîne le prononcé de sanctions ou d'aggravations de sanctions qui ne se justifient pas lorsque les deux protagonistes sont mineurs. Sans édicter un régime spécifique à ces mineurs, la généralisation du principe de particulière vulnérabilité permettrait de prendre en compte de façon plus opportune ces infractions et de leur donner une réponse satisfaisante.
