Dorothy Jackson possède de nombreuses années d’expérience et de travail aux côtés des communautés twas de la région et des femmes twas en particulier. On devine clairement les voix des femmes twas dans ce rapport, qui plaident pour des changements et la reconnaissance de leurs droits – en tant qu’autochtones et en tant que femmes. Malgré la discrimination et la pauvreté qui sont leur lot quotidien, elles sont pleines d’énergie, d’idées et de courage, ce que ce rapport suffit à démontrer. La question foncière est aujourd’hui de premier ordre pour les femmes comme pour les communautés twas. Les Twas étaient traditionnellement dépendants des forêts et des territoires sur lesquelles ils vivaient. Or aujourd’hui, la plupart des Twas sont sans terre. Leur culture et leur existence même sont en danger. Qui plus est, les changements profonds qui affectent aujourd’hui leurs sociétés sont en train de remettre en question le statut traditionnel d’égalité entre hommes et femmes. Ce rapport présente les politiques gouvernementales et les instruments juridiques internationaux relatifs aux droits humains que les Twas et les organisations qui les soutiennent pourraient utiliser au Burundi, en Ouganda, en République démocratique du Congo et au Rwanda. En guise de conclusion, le rapport offre des recommandations aux gouvernements de ces Etats et aux organisations de développement.

Book excerpt: About the publication The African Charter on the Rights and Welfare of the Child (African Children’s Rights Charter) is the continental instrument for protecting and promoting the rights and welfare of the Child. The Children’s Charter, adopted in 1990, forms part of the salient features of the African human rights system, complementing the parent human rights instrument, the African Charter on Human and Peoples Rights (African Charter). To give meaning and effect to its provisions, the African Children’s Rights Charter in article 34 establishes an organ namely the African Committee of Experts on the Rights and Welfare of the Child (African Children’s Rights Committee or Committee) to monitor implementation by member states, to advocate for children’s rights and to hold state parties accountable to their obligations as state parties. Working collaboratively on the continent’s human rights system, the organs comprising the African human rights, namely, the African Commission on Human and Peoples’ Rights (Commission), the African Court on Human and Peoples’ Rights (Court) and the African Children’s Rights Committee, have undertaken to publish the African Human Rights Yearbook. This is an instrumental platform to highlight the mandate of the organs, to foster collaboration and to illustrate Africa’s commitment to uphold human rights. It is an important initiative that highlights various aspects of the norms and institutions relevant for human rights on the continent. This is the third volume of the Yearbook. It includes a focus on the 2019 theme of the African Union Refugees, Returnees and Internally Displaced Persons: Towards Durable Solutions to Forced Displacement in Africa. The African Children’s Committee has at the same time undertaken and published a study on Children on the Move (2019), focusing not only on refugees, detainees and internally displaced persons, but also drawing inspiration from the protective mandate of the African Children’s Rights Charter to draw the continent’s attention to the protection and promotion of the rights and welfare of children who are on the move. The focus on themes of the African Union enables a critical analysis of the extent of their implementation and relevance to the human rights discourse in the continent. The role of academic writing in advancement of human rights deserves due notice and appreciation by human rights implementing bodies. Peer reviewed academic research provides credible and independent knowledge about human rights in a specific country or region, as well as in various contexts and thematic areas. Academia plays a major role in the development of a human rights resource base that enables sustainable enhancement of human rights protection and promotion. The African Human Rights Yearbook is an excellent example of the important role played by academia in strengthening human rights protection and promotion in Africa. The breadth of knowledge enveloped in the Yearbook is evidenced by the long list of highly established scholars that informed it. By questioning and analysing the institutional architecture and the work of the three human rights bodies, the Yearbook has an invaluable role of ameliorating their functioning as a collective system. Il veille que les Etats respectent et rendent compte de la mise en oeuvre des obligations qui leur incombent en vertu de la Charte. Travaillant en étroite collaboration dans le cadre de la protection des droits de l’homme en Afrique, la Commission africaine des droits de l’homme et des peuples, la Cour africaine des droits de l’homme et des peuples et le Comité africain d’experts sur les droits et le bien-être de l’enfant ont mis en place l’Annuaire africain des droits de l’homme. Cette initiative sert d’opportunité pour promouvoir les missions dévolues auxdits organes, raffermir les liens de collaboration entre eux et rappeler l’engagement pris par l’Afrique afin de protéger les droits humains. L’Annuaire est une initiative importante car elle met en exergue les différents aspects normatifs et institutionnels des droits de l’homme en Afrique. Ce troisième volume de l’Annuaire est dédié au thème que l’Union africaine a retenu pour l’année 2019; Année des réfugiés, des rapatriés et des personnes déplacées: Vers des solutions durables aux déplacements forcés en Afrique. En parallèle, le Comité a entrepris et publié une cartographie des enfants en mouvement en Afrique (2019) axée sur les réfugiés, les détenus et les déplacés internes. Tirant ses fondements du mandat de protection que confère la Charte des droits de l’enfant, la cartographie attire l’attention du continent sur la protection et la promotion des droits et du bien-être des enfants en mouvement. L’emphase sur les thèmes de l’Union africaine dans l’Annuaire permet d’examiner le degré de leur mise en oeuvre et leur importance au débat sur la question des droits de l’homme en Afrique. For example, one in three women has experienced physical and/or sexual violence since the age of 15; one in five women has experienced stalking; every second woman has been confronted with one or more forms of sexual harassment. What emerges is a picture of extensive abuse that affects many women's lives but is systematically underreported to the authorities. The scale of violence against women is therefore not reflected by official data. This FRA survey is the first of its kind on violence against women across the 28 Member States of the European Union (EU). It is based on interviews with 42,000 women across the EU, who were asked about their experiences of physical, sexual and psychological violence, including incidents of intimate partner violence ('domestic violence'). The survey also included questions on stalking, sexual harassment, and the role played by new technologies in women's experiences of abuse. In addition, it asked about their experiences of violence in childhood. Based on the detailed findings, FRA suggests courses of action in different areas that are touched by violence against women and go beyond the narrow confines of criminal law, ranging from employment and health to the medium of new technologies."--Editor.

It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.

Book excerpt: Just how International and European Community Law is being integrated into domestic legal systems is as yet not too well known. To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.
