Il apparaît que des contrats dits à exécution successive suivent le même régime que certains contrats à exécution instantanée en matière de résolution ou d'imprévision, tandis qu'au sein même des contrats dits à exécution successive le régime de la résolution diffère parfois. La notion de contrat à exécution échelonnée n'éclaire pas davantage. Aucune définition précise n'en est donnée. La distinction fondée sur le mode temporel d'exécution du contrat se révèle insatisfaisante. Une étude de certains mécanismes de droit positif invite à reconsidérer la distinction traditionnelle et à distinguer les obligations dont la naissance est successive de celles dont l'exigibilité s'étale dans le temps. Il en est ainsi par exemple de la déchéance du terme ou de la répétition de l'indu qui ne peuvent se concevoir lorsque les obligations contractuelles sont à terme, autrement dit nées au jour du contrat. Le rôle de la durée permet de distinguer les obligations contractuelles dont l'exigibilité est successive de celles dont la naissance est successive. Dans cette dernière hypothèse l'écoulement du temps renouvelle la satisfaction des parties. Les obligations naissent au fur et à mesure de l'écoulement du temps. Cette analyse d'une naissance progressive des obligations invite à reconsidérer un certain nombre de mécanismes juridiques que l'on croyait bien acquis à l'instar de la résolution ou de la suspension.
