Book excerpt: This volume concerns the ways in which verbal and non-verbal actions are combined and linked in a range of contexts in everyday conversation, in institutional contexts, and in written journalism. The volume includes an introduction which, besides presenting the content of the articles, discusses terminological fundamentals such as the understanding of the terms “clause”, “action” and “linkage” and “combining” in different grammatical traditions and the ways they are conceived of here, as well as open questions collectively formulated by the contributors in planning for the volume concerning the recognition, emergence and distance of linkage, and the ways these questions are addressed in the contributions to the volume. Topics treated in the articles include combining physical actions and verbal announcements in everyday conversation, linking of verbal and nonverbal actions as well as verbal linkages between nonverbal actions by dance teachers building pedagogical activity. Other topics concern the mediation of questions through informal translating in multilingual conversation in order to organize participation, and the ways in which student requests for clarification and confirmation create learning occasions in a foreign language classroom. Still other articles concern the on-line emergence of alternative questions with the Finnish particle vai 'or', delayed completions of unfinished turns, the transforming of requests and offers into joint ventures, and the ways in which direct quotations are created in written journalism from the original talk in the spoken interview. Most of the papers employ Conversation Analysis and Interactional Linguistics as a theoretical framework. The languages used as data are Finnish, English, Estonian, French, Brazilian Portuguese and Swedish.

Available in PDF, EPUB and Kindle. Book excerpt: Takes as its starting point the observation that a social clause should be concerned with achieving international labour rights. Analyses the conception of international labour rights involving not only law but also other disciplines such as history, morality and economics. Shows that the discussion on the social clause is emblematic of the way the WTO and the international trade system should deal with human rights in general. It requires an approach grounded in international law in the broadest sense, covering general international law, international human rights law, international trade law, international labour law and legal theory.

Available in PDF, EPUB and Kindle. Book excerpt: DRC has committed to reduce its emissions effectively, efficiently, and equitably from deforestation and degradation (REDD+). The country experiences complex relationships between drivers, agents, and institutions of deforestation nationally. The REDD+ policy arena is influenced by both governmental and non-governmental actors whose number have increased in the policy arena over the years; however, weak coordination among these actors remains an issue. Since 2009, the DRC has announced several reforms relating to land tenure, land-use planning and agricultural policy, to create an institutional environment that motivates the implementation of REDD+ in the DRC. By 2019, none of these reforms had materialized, due to both political changes and a lack of finance, capacity, and political will. Between 2013 and 2019, little progress has been made on REDD+ in the DRC, as a result of conflicting interests among actors both at national and decentralized levels; information asymmetry; elite capture and corruption; and the pre- and post-election situation. To date, the effectiveness of REDD+ activities in the DRC remain unclear, due to the absence of rigorous impact assessment. However, efforts can be observed on the field where there is increased number of participants to forest policy process compared to REDD+ early years; and several ongoing projects are testing policy options within and across levels. If these efforts are sustained, they can contribute in putting in place conditions to achieve REDD+ objectives.

Book excerpt: This volume presents a wide selection of studies on the issues of law, land dispute and conflict (mediation) in Africa, reconsidering the role of state agents and other actors in these matters. The focus is on analyzing how citizens, state institutions and concerned (inter)national actors aim to find solutions to disputes, tension and conflict that are part of social life. The authors have approached the subject of Land, Law and Politics in Africa from a variety of disciplinary angles. The issues at stake comprise land access and land use, state politics and democratization efforts, the relationship between constitutional/state law and customary law, the challenges of urban and rural conflicts, border issues and the conceptions of (human) rights. On the basis of new empirical studies, the authors plead for a more holistic perspective on the above issues and on developmental policy in general. The book has 15 chapters in four thematic parts, focusing on historical and cultural aspects of politics and authority; land law and land disputes; constitutionalism and politics; and conflict studies. The volume is also a tribute to the work of Gerti Hesseling (1946-2009), a Dutch Africanist with a successful career as a scholar of constitutional and land law, focusing on West Africa.

Available in PDF, EPUB and Kindle. Book excerpt: Congolese logging camps are places where mud, rain, fuel smugglers, and village roadblocks slow down multinational timber firms; where workers wage wars against trees while evading company surveillance deep in the forest; where labor compounds trigger disturbing colonial memories; and where blunt racism, logger machismo, and homoerotic desires reproduce violence. In Rainforest Capitalism Thomas Hendriks examines the rowdy world of industrial timber production in the Democratic Republic of the Congo to theorize racialized and gendered power dynamics in capitalist extraction. Drawing on ethnographic fieldwork among Congolese workers and European company managers as well as traders, farmers, smugglers, and barkeepers, Hendriks shows how logging is deeply tied to feelings of existential vulnerability in the face of larger forces, structures, and histories. These feelings, Hendriks contends, reveal a precarious side of power in an environment where companies, workers, and local residents frequently find themselves out of control. An ethnography of complicity, ecstasis, and paranoia, Rainforest Capitalism queers assumptions of corporate strength and opens up new ways to understand the complexities and contradictions of capitalist extraction.

Available in PDF, EPUB and Kindle. Book excerpt: Hanns Ullrich, this highly renowned legal scholar, has had a tremendous influence on legal research and the development of the law in the fields of both Technology and Competition. His expertise dates back to the late 1970s and early 1980s, when he served as a member of the research staff at the Max Planck Institute for Intellectual Property in Munich. In 1985, he became professor of law at the "Universität der Bundeswehr", Munich, and finally, in 2000, professor at the european University Institute, florence. He has acted as visiting professor at a number of Universities around the worldincluding, in particular, the College of Europe, Bruges. The authors of the contributions in this book feel greatly indebted to Hanns Ullrich. Much earlier than others, he recognised and explained that, in the absence of pressure from competition, intellectual property will not be able to fulfil its mission of enhancing innovation. In concentrating on the fields of interest of this eminent scholar, the contributions address a number of the most burning issues of the regulation of intellectual property, competition law and, of course, the application of competition law to IP-related cases.

Available in PDF, EPUB and Kindle. Book excerpt: In Extravagance and Misery: The Emotional Regime of Market Societies, Alan Thomas, Alfred Archer, and Bart Engelen investigate the extensive and growing economic inequalities that characterize the affluent market societies of the West. Drawing on insights from political philosophy and the new science of happiness, they show the damaging impact that existing inequalities have on our well-being, and offer an explanation for what went wrong in our highly unequal and frequently unhappy societies. Combining the approaches of philosophy and political economy, the authors expose the economic, social and political mechanisms that create and perpetuate economic inequalities. They employ research from the new science of happiness to assess the impact of those mechanisms on the well-being of the poor, the middle class and the rich. They scrutinize the role of key emotions, such as shame (amongst the poor), envy and admiration (towards and for the rich) as well as discussing which emotional narratives serve to justify and entrench excessive inequalities in income and wealth. The result is an explanation of the emotional regime that characterizes our capitalist societies and that perpetuates the unfair gap between the extravagance of the rich and the misery of the poor. Extravagance and Misery concludes with a proposal of how to re-shape this emotional regime in the interests of justice and solidarity.

Book excerpt: This volume contains a consolidated reproduction of Part One (articles 1 to 35) of the Draft Article on State Responsibility & their important Commentaries, prepared by the International Law Commission in the period ending in 1980. These articles deal with the origin of international responsibility, including general principles, the act of State, breach of an international obligation, & circumstances precluding wrongfulness. They were drawn up on the basis of eight reports submitted by the Special Rapporteur, Professor, now Judge Roberto Ago. An introduction written by Shabtai Rosenne traces the history of the official codification of the topic of State Responsibility since the League of Nations first broached the matter in 1924. State Responsibility is central to the daily practice of international law, & its systematic treatment is central to the codification process. The International Law Commission is continuing work on the topic. In the meantime, the articles of Part One, now concentrated for the first time in a single volume, are the major starting point for this work. This volume will be of great value to practitioners, teachers & students of international law. Shabtai Rosenne was a member of the International Law Commission from 1962 to 1971, when the basic decisions regarding the approach to the current phase of the work were taken.
