This book was released on 1991 with total page 52 pages. Available in PDF, EPUB and Kindle.
Book Synopsis Constitutional Law and Politics of Secession by : Antoni Abat i Ninet
Download or read book Constitutional Law and Politics of Secession written by Antoni Abat i Ninet and published by Taylor & Francis. This book was released on 2023-07-31 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection presents an analysis of the concept of secession and its constitutional accommodation alongside an assessment of the effects of secession in constitutional and international law. The work proposes a new approach and insights into the existing literature that fill a gap from multidisciplinary and transdisciplinary perspectives. The book approaches the topics of secession, constitutionalism, and their relationship from both theoretical and empirical perspectives, including the analysis of particular secessionist examples, such as Catalonia, the Basque Country, Tigray, the Palestinian minority in Israel, Bosnia and Herzegovina, and the Mapuche Nation, from a comparative constitutional perspective. Elucidating these issues from different methodological and conceptual perspectives produces novelties in the scientific and constitutional debate. The interplay between constitutions, constitutional law, and secession is indeed explored from philosophical, socio-legal, but also from strict constitutional law outlooks. Written by constitutional and public international law experts, the book will be of interest to students, academics, and researchers working in the areas of constitutional law, legal theory, theory of the state, philosophy of law, and political science.

Book Synopsis Local Governance in Multi-Layered Systems by : Matteo Nicolini
Download or read book Local Governance in Multi-Layered Systems written by Matteo Nicolini and published by Springer Nature. This book was released on 2023-12-12 with total page 485 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book provides a comprehensive analysis of local government in federations. It fills the gap in current legal research and positions local government in federal studies through the lenses of comparative law, adopting a more nuanced approach to local government. The book considers the shortcomings between the black-letter constitution and its operational rules. Whether (and how) the regime of local government is implemented is more relevant than its formal-but-ineffective recognition. The comparative survey discloses the variety local institutions take in different federal contexts. Divided into three parts, the book comprises chapters investigating local government in systems that, to various degrees, have been examined and classified as federal. Scholars throughout the world have examined the federal-local connection in aggregative federations, (the USA, Canada, Switzerland, Germany, Australia, and Austria), devolutionary ones (Belgium, Bosnia Herzegovina, Italy, Spain, the UK, Argentina, Brazil, Mexico, and the Russian Federation), as well as in federations beyond the West, where federalism-as-a-colonial-legacy has undergone a process of reinvention affecting the federal-local connection (South Africa, Ethiopia, India, Nigeria, Comoros, Democratic Republic of Congo, Nepal, Palau, Federated States of Micronesia; St. Kitts and Nevis; United Arab Emirates; and Pakistan).
Book Synopsis Restructuring Relations by : Rauna Kuokkanen
Download or read book Restructuring Relations written by Rauna Kuokkanen and published by Oxford University Press. This book was released on 2019-03-01 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Adopted in 2007, the UN Declaration on the Rights of Indigenous Peoples establishes self-determination--including free, prior, and informed consent--as a foundational right and principle. Self-determination, both individual and collective, is among the most important and pressing issues for Indigenous women worldwide. Yet Indigenous women's interests have been overlooked in the formulation of Indigenous self-government, and existing studies of Indigenous self-government largely ignore issues of gender. As such, the current literature on Indigenous governance conceals patriarchal structures and power that create barriers for women to resources and participation in Indigenous societies. Drawing on Indigenous and feminist political and legal theory--as well as extensive participant interviews in Canada, Greenland, and Scandinavia-- this book argues that the current rights discourse and focus on Indigenous-state relations is too limited in scope to convey the full meaning of "self-determination" for Indigenous peoples. The book conceptualizes self-determination as a foundational value informed by the norm of integrity and suggests that Indigenous self-determination cannot be achieved without restructuring all relations of domination nor can it be secured in the absence of gender justice. As a foundational value, self-determination seeks to restructure all relations of domination, not only hegemonic relations with the state. Importantly, it challenges the opposition between "self-determination" and "gender" created and maintained by international law, Indigenous political discourse, and Indigenous institutions. Restructuring relations of domination further entails examining the gender regimes present in existing Indigenous self-government institutions, interrogating the relationship between Indigenous self-determination and gender violence, and considering future visions of Indigenous self-determination, such as rematriation of Indigenous governance and an independent statehood.

Book Synopsis Curriculum: Construction and Critique by : Prof Alistair Ross
Download or read book Curriculum: Construction and Critique written by Prof Alistair Ross and published by Routledge. This book was released on 2003-09-02 with total page 210 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although curriculum is central to the schooling process, debates about it are rarely well informed. Over the past ten years there has been a dearth of books that have informed the debate by examining curriculum in a broader context, beyond the National Curriculum. Ross, in this refreshing re-examination of the area, opens up a more general debate on how the curriculum is shaped and the compromises made between different ideologies of the nature and purpose of education.
Book Synopsis Diplomacy and the Arctic Council by : Danita Catherine Burke
Download or read book Diplomacy and the Arctic Council written by Danita Catherine Burke and published by McGill-Queen's Press - MQUP. This book was released on 2020-01-16 with total page 159 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Arctic Council, created in 1996, has facilitated over twenty years of successful democracy and regional cooperation between Russia and the seven other Arctic states – the United States, Canada, Norway, Denmark, Iceland, Sweden, and Finland. What has allowed this unity to continue despite political turmoil between these nations? In Diplomacy and the Arctic Council Danita Burke argues that the Arctic Council is a club: a group of states that mutually benefit from voluntary collaboration and that use the forum as a vessel to help define and guide the parameters of their cooperation. How the club members identify and address challenges reflects power relations among them, which vary depending on the topic under discussion or debate. Providing insight into the daily practices of the Arctic Council and the relative status of its member states, Burke seeks to understand why major international events, such as the 2014 Russian-Ukrainian conflict over the Crimea region, do not deter the Arctic countries from cooperating. The author posits that the Arctic Council's club structure and its strategy of practising and projecting unity have allowed it to weather the storm of international conflicts involving its core membership. Through interviews with representatives from the Arctic states and Indigenous peoples, Diplomacy and the Arctic Council offers a unique look into the diplomatic practices of the council after more than two decades of operation.
