Available in PDF, EPUB and Kindle. Book excerpt: Proceedings of a conference held at the University of Kent, 11th and 12th October 2008 There has been, in recent years, a quickening of interest in the condition of Italy and state of those who lived there during the Roman republic. The diverse nature of the evidence, both historical and archaeological, has stimulated scholarly debate. New techniques and ideas are being brought to bear on old questions with interesting results. The papers in this volume, by both historians and archaeologists, are a contribution to the debate. They look at Italy and Rome from an Italian as well as from a Roman perspective. Dogmatism has been avoided in order to present different viewpoints and individual perspectives. Out of such diversity there eventually comes progress in understanding. A wide range of topics will be found scrutinised and discussed here. Issues covered include villas, the ager publicus and agriculture, Italian participation in Roman politics, Roman agricultural writers and some of the methodological problems our evidence poses.

Book excerpt: Recent research has called into question the orthodox view that the last two centuries of the Roman Republic witnessed a decline of the free rural population. Yet the implications of the alternative reconstructions of Italy's demographic history that have been proposed have never been explored systematically. This volume offers a series of in-depth discussions not only of the republican manpower and census figures but also of the abundant archaeological data. It also explores the growth of cities, especially Rome, and the changing distribution of the population over the Italian landscape. On the rural side it addresses the interplay between demographic, economic, and legal developments and the background to the Gracchan land reforms. Finally it examines the political implications of demographic growth and large-scale migration to the provinces. The volume as a whole demonstrates that demography is the key to many aspects of Italy's economic, social, military, and political history.

How did these change over time and in response to local conditions? To what extent did local agents facilitate and contribute to the creation of imperial administrative institutions? The answers to these questions shape our understanding of how the Roman empire established and maintained hegemony within its provinces. This issue of imperial hegemony is particularly acute for the period during which the political apparatus of the Roman Republic was itself in crisis and flux--precisely the period during which many provinces first came under Roman control. Imperial Power, Provincial Government, and the Emergence of Roman Asia, 133 BCE-14 CE uses a case study of the province of Asia to focus closely on the formation and evolution of the Roman empire's administrative institutions. Comparatively well-excavated, Asia's rich epigraphy lends itself to this detailed study, while the region's long history of autonomous civic diplomacy and engagement with a range of Roman actors provide vital evidence for assessing the ways in which Roman empire and hegemony affected conditions on the ground in the province. Asia's unique history, moving from allied kingdom to regularly assigned provincia to a reconquered and reorganized territory, offers an insight into the complex workings of institutional formation. From an investigation of the institutions which emerged in the province over a long first century (133 BCE-14 CE), Bradley Jordan considers the discursive power of official utterances of the Roman state, and the strategies employed by local actors to negotiate a favourable relationship with the empire.

Available in PDF, EPUB and Kindle. Book excerpt: Ancient Rome is the only society in the history of the western world whose legal profession evolved autonomously, distinct and separate from institutions of political and religious power. Roman legal thought has left behind an enduring legacy and exerted enormous influence on the shaping of modern legal frameworks and systems, but its own genesis and context pose their own explanatory problems. The economic analysis of Roman law has enormous untapped potential in this regard: by exploring the intersecting perspectives of legal history, economic history, and the economic analysis of law, the two volumes of Roman Law and Economics are able to offer a uniquely interdisciplinary examination of the origins of Roman legal institutions, their functions, and their evolution over a period of more than 1000 years, in response to changes in the underlying economic activities that those institutions regulated. Volume II covers the concepts of exchange, ownership, and disputes, analysing the detailed workings of credit, property, and slavery, among others, while Volume I explores Roman legal institutions and organizations in detail, from the constitution of the Republic to the management of business in the Empire. Throughout each volume, contributions from specialists in legal and economic history, law, and legal theory are underpinned by rigorous analysis drawing on modern empirical and theoretical techniques and methodologies borrowed from economics. In demonstrating how these can be fruitfully applied to the study of ancient societies, with due deference to the historical context, Roman Law and Economics opens up a host of new avenues of research for scholars and students in each of these fields and in the social sciences more broadly, offering new ways in which different modes of enquiry can connect with and inform each other.

Available in PDF, EPUB and Kindle. Book excerpt: There are no legal institutions other than pignus and hypotheca (i.e. mortgage) where the formative effect of legal practice can be so clearly observed. Security and Credit in Roman Law outlines the legal history of these institutions in terms of an iterative relationship between transactional lawyers drafting legal transactions and Roman jurisprudence deploying its analytical skills in order to accommodate new transactional practices into the Roman legal system. The evolution of the Roman law of real security, well known through the legal sources (Justinian's Digest and Code), is reconstructed, while matching it with actual banking practices, in particular the secured lending transactions documented in the archive of the Sulpicii. In the late classical period the imperial chancery increasingly interfered with it in order to provide a considerable degree of protection to debtors. The (largely but certainly not completely) spontaneous evolution of Roman law produced a law of secured transactions which was highly sophisticated and versatile, allowing non-possessory security, multiple charges, pledges of receivables, antichretic pledges, and even floating charges over a dynamic fund of assets. Since legal systems often adapt in reaction to impulses from their economic environment, the complexity of the Roman law of real security indicates that pignus and hypotheca did play a significant role in the Roman economy. It will be shown that this role was generally a positive one. Its main weaknesses were lack of publicity and the presence of fiscal charges: even these weaknesses did not undermine the effectiveness of secured transactions.

Book excerpt: For much of the postwar era, French society had a contradictory view of passenger trains, scorning them as quaint anachronisms on the one hand, yet also fearing their economic and social impact. All this changed with the introduction of the famed Train á Grande Vitesse (TGV) between Paris and Lyon in the early 1980s. In vivid detail, Meunier describes the political, economic, and social factors that both helped and hindered the development of the world's fastest, most technologically advanced train. The present-day enthusiasm in France for high-speed rail travel dates only to the successful launch of the now-famous TGV in 1981. Until now, most published accounts of French high-speed rail have been of a technical nature and have ignored or minimized the historical, political, economic, and social context. Historians have been left with detailed descriptions of locomotives and experimental test runs, but there has been scant information cercerning why the machines were built and why the tests were carried out in the first place. This book is the first full-length treatment of high-speed rail travel and the bibliography is one of the most complete on the subject.
