Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to present the law of the Baltic States in one comprehensive and coherent volume in English. The Baltic States region, which was incorporated by the Soviet Union for 50 years and now is the only such territory in the EU, continues to be characterized by a number of unique traits, problems and developmental trends. This book addresses these facets of law – the status quo, problems and trends – by adopting a comparative perspective structure for all three Baltic States (divided into three main parts – Estonia, Latvia and Lithuania). Each of these parts examines similar core aspects: General Frameworks, Public Law, and Private Law. Taking into account the peculiarities of each country, the individual chapters provide analyses of principles, problems and developments in specific legal branches. The authors of the book are recognized academics and professionals in the field of law. Taken together, their contributions offer a valuable tool and resource for anyone interested in the law of the Baltic States: students, legal practitioners, scholars, administrators, etc.

Based upon a profound analysis of the Baltic States’ historic development and international legal status, this book examines the gradual development of bilateral relations between the EU and each of the Baltic countries. It discusses the strategic policy choices made in the EU’s fifth enlargement wave and the consequences of its pre-accession strategies. Specific attention is devoted to the impact of enlargement on the triangular relationship between the EU, the Baltic States and Russia. Finally, the constitutional changes within the Baltic States and within the European Union itself are taken into account.

Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the way in which legal historians and legal scientists used the past to legitimize, challenge, explain and familiarize the socialist legal orders, which were backed by dictatorial governments. The volume studies legal historians and legal histories written in Eastern European countries during the socialist era after the Second World War. The book investigates whether there was a unified form of socialist legal historiography, and if so, what can be said of its common features. The individual chapters of this volume concentrate on the regimes that situate between the Russian, and later Soviet, legal culture and the area covered by the German Civil Code. Hence, the geographical focus of the book is on East Germany, Russia, the Baltic states, Poland and Hungary. The approach is transnational, focusing on the interaction and intertwinement of the then hegemonic communist ideology and the ideas of law and justice, as they appeared in the writings of legal historians of the socialist legal orders. Such an angle enables concentration on the dynamics between politics and law as well as identities and legal history. Studying the socialist interpretations of legal history reveals the ways in which the 20th century legal scholars, situated between legal renewal and political guidance gave legitimacy to, struggled to come to terms with, and sketched the future of the socialist legal orders. The book will be a valuable resource for academics and researchers working in the areas of Legal History, Jurisprudence and Philosophy of Law and European Studies. Available in PDF, EPUB and Kindle. Book excerpt: The International Law Commission, when drafting articles on nationality of persons in situations of State succession, omitted cases of unlawful territorial changes. These do not result in State succession; they may be dealt with under the rubric of State continuity. The Baltic – Russian cases show the particularly complex nature of these situations, both as concerns agreement on continuity and decisions on nationality. The author examines in detail the Citizenship Laws of the Baltic States and Russia, as well as relevant constitutional and international statements about the international legal status of the States and responses of the international community thereto. The main question addressed in the book is about solutions which States have to adopt concerning nationality of individuals in situations of State continuity, especially where States re-emerge after long years of occupation. Although the book is specific in its origin, it is of general importance because it draws conclusions concerning developments in law and practice which are relevant for a better understanding and regulation of nationality and statehood in international law.

Book excerpt: Seminar paper from the year 2005 in the subject Politics - International Politics - Region: Eastern Europe, grade: 1,0, University of Latvia (Department of Political Science), course: Politics and Policy in Baltic States, 16 entries in the bibliography, language: English, abstract: The paper will be divided in two main parts: The first part is about the structures and the functions of the EU institutions. This presentation will be focused on three institutions of the EU: The European Commission, The Council of the European Union and The European Parliament, due to the fact that this "institutional triangle" produces the policies and laws that apply throughout the EU. Any of these institutions will be introduced in an own subchapter by explaining their composition, procedures and functions. ...] Important to mention is that the "Council of the European Union" should not to be confused with the "Council of Europe", an organisation separate from the EU with a wider membership, or with the "European Council", the meeting of the heads of state and government of the EU together with members of the Commission (Archer 2000:44). In the following the terms "Council" and "Council of Ministers" are only used as synonyms for "The Council of the European Union". The presentation of the institutions of the EU will be followed by an overview about the EU accession procedures of the three Baltic States. This chapter will be introduced by a short description of the official regulations to become a member of the EU, more precisely a description of "the eight stages to EU". These mentioned backgrounds are essential for the following second part of the paper, the empirical analyse of the attitudes of the Baltic population to the European Union. It is mainly based on aggregate data of several editions of the Eurobarometer, which will be introduced in an own section. Other, also on aggregate data based surveys, are used, if they show significant different results or if they contain some

Book excerpt: This volume of the Baltic Yearbook of International Lawcontains materials from a conference entitled "The Approaches of Liberal and IlliberalGovernments to International Law: A Conference Marking 25 Years since the Collapse of Communist Regimes in Central and Eastern Europe" that was held in the building of the Estonian Academy of Sciences on 12-13 June 2014. The conference was co-organized by the Faculty of Law of the University of Tartu and the European Society of International Law's interest group on international legal theory (ILTIG).The Baltic Yearbook of International Law is the first legal journal in the field of international law published under the auspices of the Baltic Editorial Board that attempts to bring to the international debate the issues that are of importance in the Baltic States and provides a forum for the views of, among others, Baltic international scholars on various topical themes of international law. The first volume appeared in 2001 with the symposium on the question of International Legal Status of the Baltic States. The Yearbook contains State practice reports from Estonia, Latvia and Lithuania and thus serves as an important source of information that is not available elsewhere. Editing of this volume was supported by grant IUT20-50 of the Estonian Research Council.

Book excerpt: Urban and regional development in the Baltic States and other Central and Eastern European countries has experienced rapid changes since their re-independence at the beginning of the 1990s. Meanwhile, urban and regional planning institutions and organizational cultures in the Baltic States have only changed rather incrementally, despite various national and European pressures for reform. As a consequence, the effects of European cohesion and structural policy measures have been quite modest, and the ability of the planning systems in the Baltic states to manage contemporary trends in urban and regional development has become increasingly limited. This book focuses on these issues and tensions of spatial planning and development in the Baltic States and their distinctiveness compared to other European countries. It provides an overview of the historical and cultural context of spatial development, a discussion of the processes of Europeanization of spatial planning in the specific context of the Baltic States, and an analysis of whether these processes may be leading to policy convergence in the region. This book was published as a special issue of European Planning Studies.
