It discusses the tools of persuasion and the marshaling of facts, law and form to produce a winning motion. Instead of merely laying out the rules, the book outlines the analysis that the lawyer must make in writing and presenting a motion.

This book was released on 2020-08-23 with total page 38 pages. Available in PDF, EPUB and Kindle. Book excerpt: Civil legal action is battlefield by "words" put in writing from the very beginning of filing a Complaint and Summons, then, going forward by filing of Motions and Briefs, etc. When there is a legal controversy, sue or be sued, the involved parties may feel strongly that it is the other party's fault. He/She/It wants justice, wants to tell the judge how wrong the other party is, and believes once the judge hears (or, reads) the "real story" the judge will rule in his/her/its favor for justice to be served. But before any judge will "hear" any party utters his/her/its side of the story, the judge will first "read" the side of the story from the parties, in "writing" on "paper" "filed" to the court. Legal research is the key to understand judges' legal analysis, rationale, and thought process. We will discuss legal research later in this eBook. "Reading" is a large part of your legal pursuit. Knowledge is power. A good reading habit is a must when you decide to represent yourself in court. The more judges' opinions you can read, the more understanding you will soon develop of the laws, either statutory or common law, which eventually will help you strengthen your legal action when writing motions and arguing in court hearings. Often, you may have to read the same opinion a few times, or many times, before you can comprehend the legal grounds. When you receive your opponent's documents, you may also need to read the documents several times before you make a move. Being emotionally charged and putting yourself in reaction mode are easy mistakes that Pro Se litigants make time and again. Do not read court documents amid doing tasks. Find quiet time and place, then, read thoroughly. There are phases in a legal proceeding: for instance, the beginning, the ending, and a whole lot of stuff in the between. But, mainly, you can categorize it into major three phases while many movements/acts may take place (e.g., filing motions, notices and/or submitting documents as material evidence and/or as references for courts' review) in each phase. Each movement/act is like a battle, big or small, to reach the end goal of winning the legal war; therefore, strategy is vital in any litigation.Motions require legal grounds and good causes that are circumstances allowing you to make a move under the rules of civil procedures and laws. In rules of civil procedures, for instance, litigants are allowed extra time needed to complete the necessary filing (the legal grounds) but they must have good reasons (the good causes.) When writing an arguable motion, you will need to do legal research to back up your argument. In the hearing for your arguable motion, you need to refer to your legal research collected and written in your argument. As there are many ways leading to Rome, so are many ways leading to do your legal research.

Book excerpt: Motions shape the battlefield of courtroom practice. Whether providing advanced knowledge of the admissibility of alleged prior bad acts by a client or seeking a ruling on a proposed panel instruction, motions in military practice are instrumental in preparing for the war of a court-martial trial. Failing to approach motions practice as a pivotal step in shaping the battlefield for the war of a court-martial trial does a disservice to one's client. This book dares you to step away from the "shared drive" and instead to take a fresh approach with each motion for every case. I have dissected my own process and am providing the insight that I derived for your benefit in the form of this book. My law firm's mantra is that we want to be where we can do the most good. My goal for this book is the same: to elevate the practice. One motion at a time.

Book excerpt: Rich in information, Motion for Justice: -- I Rest My Case shares Brian Vukadinovich's experiences and intimate knowledge of governmental and judicial corruption and what went on behind the scenes in Indiana for years in efforts to take away his freedom and livelihood as a teacher. Motion for Justice: -- I Rest My Case, in a straightforward, no-holds-barred style, will open your eyes to government and judicial corruption that you have never before heard or seen the likes of. Brian Vukadinovich minces no words when he writes about his journey for justice, calling out high-level state and federal officials, including state and federal judges, for undermining Vukadinovich's efforts in exposing government corruption. Motion for Justice: -- I Rest My Case will show how law enforcement agencies in Indiana conspired to take his freedom away from him by falsely arresting and vindictively prosecuting him on numerous occasions and how Brian Vukadinovich successfully took on the corrupt police in many of the cases representing himself and successfully arguing for dismissal of the bogus charges. In Motion for Justice: -- I Rest My Case, you will read how John Bolton, as assistant attorney general of the U.S. Department of Justice at the time, and current national security adviser to President Trump, turned a blind eye to significant evidence of police-corruption activities against Brian Vukadinovich. Motion for Justice: -- I Rest My Case will show how numerous lawyers teamed up in efforts to have Brian Vukadinovich fired from teaching jobs and how he took on the corrupt lawyers and won two federal lawsuits, including a five-day jury trial in March 2016, when he represented himself and convinced a federal jury that the corporation violated his due process rights and awarded him damages of $203,840.39. The case received substantial national attention. In writing the powerful foreword to Motion for Justice: -- I Rest My Case, Richard A. Posner, retired longtime distinguished judge of the United States Court of Appeals for the Seventh Circuit, called Brian Vukadinovich "A wonderful American success story" calling him "determined, indomitable, fearless, and daring." "Brian is not only a terrific litigator; he is a terrific writer, as the reader of this book will soon learn. Richard A. Posner Retired judge of the United States Court of Appeals for the Seventh Circuit "Vukadinovich has plenty to say - a luxury many lawyers often don't have." Indiana Lawyer Vol. 27 No. 21 - December 14-27, 2016 "Since 1981, Vukadinovich has been arrested by Valparaiso police seven times. Each time, he was found not guilty or charges were dismissed." The Vidette Messenger - January 4, 1992 "After one arrest, he left jail with a broken jaw; after another, he was handcuffed in a patrol car with a police dog." The Indianapolis Star - May 8, 1988
