Book excerpt: Carbon Pollution Emission Guidelines for Existing Stationary Sources - Electric Utility Generating Units (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Carbon Pollution Emission Guidelines for Existing Stationary Sources - Electric Utility Generating Units (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 In this action, the Environmental Protection Agency (EPA) is establishing final emission guidelines for states to follow in developing plans to reduce greenhouse gas (GHG) emissions from existing fossil fuel-fired electric generating units (EGUs). Specifically, the EPA is establishing: Carbon dioxide (CO 2) emission performance rates representing the best system of emission reduction (BSER) for two subcategories of existing fossil fuel-fired EGUs-fossil fuel-fired electric utility steam generating units and stationary combustion turbines; state-specific CO 2 goals reflecting the CO 2 emission performance rates; and guidelines for the development, submittal and implementation of state plans that establish emission standards or other measures to implement the CO 2 emission performance rates, which may be accomplished by meeting the state goals. This final rule will continue progress already underway in the U.S. to reduce CO 2 emissions from the utility power sector. This book contains: - The complete text of the Carbon Pollution Emission Guidelines for Existing Stationary Sources - Electric Utility Generating Units (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) - A table of contents with the page number of each section

Available in PDF, EPUB and Kindle. Book excerpt: Since the beginning of the Obama Administration, conservative politicians have railed against the President's "War on Coal." As evidence of this supposed siege, they point to a series of rules issued by the Environmental Protection Agency that aim to slash air pollution from the nation's power sector . Because coal produces far more pollution than any other major energy source, these rules are expected to further reduce its already shrinking share of the electricity market in favor of cleaner options like natural gas and solar power. But the EPA's policies are hardly the "unprecedented regulatory assault " that opponents make them out to be. Instead, they are merely the latest chapter in a multi-decade struggle to overcome a tragic flaw in our nation's most important environmental law. In 1970, Congress passed the Clean Air Act, which had the remarkably ambitious goal of eliminating essentially all air pollution that posed a threat to public health or welfare. But there was a problem: for some of the most common pollutants, Congress empowered the EPA to set emission limits only for newly constructed industrial facilities, most notably power plants. Existing plants, by contrast, would be largely exempt from direct federal regulation-a regulatory practice known as "grandfathering." What lawmakers didn't anticipate was that imposing costly requirements on new plants while giving existing ones a pass would simply encourage those old plants to stay in business much longer than originally planned. Since 1970, the core problems of U.S. environmental policy have flowed inexorably from the smokestacks of these coal-fired clunkers, which continue to pollute at far higher rates than their younger peers. In Struggling for Air, Richard L. Revesz and Jack Lienke chronicle the political compromises that gave rise to grandfathering, its deadly consequences, and the repeated attempts-by presidential administrations of both parties-to make things right.

Book excerpt: This practical guide to air pollution law governing stationary sources is essential to fully deciphering, applying, and complying with this highly complex area of the law. Corporate counsel, attorneys for regulated sources, federal, state, and local compliance officials and prosecutors, technical consultants, teachers of environmental law, students, legislators, and environmental policymakers will all benefit from Professor Reitze's clear, extensive analysis. This work builds on Professor Reitze's earlier work, Air Pollution Control Law: Compliance and Enforcement, to provide expanded coverage of new source review, hazardous air pollutants, interstate air pollution control, preconstruction and operating permits, and enforcement issues. Whether you are new to environmental law or have considerable experience with the Clean Air Act, this book is an invaluable companion to working your way through the regulatory maze surrounding stationary sources.

Protecting the president from too much isolation are advisers and aides who help ensure that the administration achieves its policy goals while enjoying broad political support. In economics and environmental policy, where disagreement among stakeholders and expert opinion is especially strong, the president needs good advice about political strategy, as well as unbiased information about the substance of policy issues. It is the latter need that the Council of Economic Advisers (CEA) is intended to address. Painting the White House Green collects personal essays by eight Senior Staff Economists for Environmental and Natural Resource Policy who worked within the CEA from 1992 to 2002. These authors confirm the council's 'severe' view of many environmental initiatives, a perspective that led President Clinton to label his economic advisers as 'lemon suckers.' At the same time, they demonstrate that the emphasis on efficiency was to offer more effective environmental protection at lower cost. Thinking 'green' meant thinking consistently about both economics and the environment. The essays in this innovative book present lively debates on clean air, climate change, and electricity deregulation that pitted economists at CEA, the Office of Management and Budget, and often the Treasury Department, against political advisers in the White House and officials at EPA and other agencies. The essays present vivid portraits of the power plays involved in environmental policymaking, rare insights into presidential decisionmaking, and revealing details of the ways that economic thinking influences-or is neglected-in a wide range of policy decisions.

Available in PDF, EPUB and Kindle. Book excerpt: Over the past decades, considerable debate has emerged surrounding the use of cost-benefit analysis (CBA) to analyze and make recommendations for environmental and safety regulations. Critics argue that CBA forces values on unquantifiable factors, that it does not adequately measure benefits across generations, and that it is not adaptable in situations of uncertainty. Proponents, on the other hand, believe that a well-done CBA provides useful, albeit imperfect, information to policymakers precisely because of the standard metrics that are applied across the analysis. Largely absent from the debate have been practical questions about how the use of CBA could be improved. Relying on the assumption that CBA will remain an important component in the regulatory process, this new work from Resources for the Future brings together experts representing both sides of the debate to analyze the use of CBA in three key case studies: the Clean Air Interstate Rule, the Clean Air Mercury Rule, and the Cooling Water Intake Structure Rule (Phase II). Each of the case studies is accompanied by critiques from both an opponent and a proponent of CBA and includes consideration of complementary analyses that could have been employed. The work's editors - two CBA supporters and one critic - conclude the report by offering concrete recommendations for improving the use of CBA, focusing on five areas: technical quality of the analyses, relevance to the agency decision-making process, transparency of the analyses, treatment of new scientific findings, and balance in both the analyses and associated processes, including the treatment of distributional consequences.
