C'est pourquoi il faut renforcer les mécanismes d'intégrité du marché unique et de notre Union » . Un tel mécanisme abordé par le Président de la Commission Européenne, José Manuel Durão BARROSO, se trouve dans la proposition de règlement du Parlement européen et du Conseil relatif à un droit commun européen de la vente (document « COM (2011) 635 final ») . Cette proposition reconnaît que « les divergences entre les droits des contrats [...] ont pour effet de restreindre la concurrence sur le marché intérieur» ; c’est pourquoi faciliter le développement du commerce transfrontalier grâce à une harmonisation du droit contractuel est « l’objectif général » du projet . Ainsi, le droit joue encore et toujours le rôle central pour parvenir à la vision d’une Europe unifiée, en passant avant tout par le marché unique. Le DCEV incorpore une pluralité de concepts juridiques. La présente étude a pour but de mettre l’accent sur la question de l’effet relatif du contrat. Seront donc ici évoqués deux mécanismes dérogatoires à ce principe, à savoir la stipulation pour autrui (Vertrag zugunsten Dritter) et la liquidation de dommages d’un tiers (Drittschadensliquidation). Le but de la présente étude est de faire une analyse comparative entre le droit français, le droit allemand et le DCEV: Il s’agira, dans un premier temps, d’apprécier le contenu du nouvel article 78 DCEV en le comparant aux stipulations pour autrui des droits nationaux. Cette limite au principe de l’effet relatif est à l’origine de la volonté des parties et fait l’objet d’une codification dans chaque ordre juridique dont les différentes spécificités seront confrontées (PARTIE I). Dans un second temps, il conviendra d’aborder le domaine de réparation de dommages d’un tiers. À défaut d’une disposition au niveau européen, recourir aux droits nationaux est indispensable. On y retrouvera alors une différence conceptuelle dont les solutions sont fortement marquées par la jurisprudence (PARTIE II).
