Les données, à partir du moment où elles transitent ou sont stockées sur un ordinateur connecté à internet, sont susceptibles d'être attaquées par une personne connectée. Dans ce travail, nous nous intéressons aux cadres législatifs encadrant la vie privée et les données de santé, puis aux moyens techniques assurant leur protection. Nous décrivons et analysons des pratiques de terrain par les résultats d'un questionnaire portant sur l'application des recommandations par les pharmaciens d'officine et leurs employés. Nous évoquerons pour finir les améliorations procédurales envisageables compte tenu des résultats du questionnaire.

In addition to physicians and nurses, these were representatives of the disciplines of the behavioral sciences, system theory, economics, engineering, and the emergency fields of management science and informatics -all concerned with the development of health resources in a broad system context. The reported research and experience of the many disciplines represented had dealt with one or more of three concerns: 1) a major health problem, such as cardiovascular disease, or an important popUlation at risk, such as the elderly or children or workers; 2) some generic aspect of organization and decision making, including trial and evaluation ofinnovative health strategies; and 3) the methodology of research and analysis in system of health service. The challenge to the conference organizers lay in the eliciting and arranging of experiences in such a way that the health services could be seen as purposeful,living, evolving systems.

Book excerpt: This book identifies and explains the different national approaches to data protection – the legal regulation of the collection, storage, transmission and use of information concerning identified or identifiable individuals – and determines the extent to which they could be harmonised in the foreseeable future. In recent years, data protection has become a major concern in many countries, as well as at supranational and international levels. In fact, the emergence of computing technologies that allow lower-cost processing of increasing amounts of information, associated with the advent and exponential use of the Internet and other communication networks and the widespread liberalization of the trans-border flow of information have enabled the large-scale collection and processing of personal data, not only for scientific or commercial uses, but also for political uses. A growing number of governmental and private organizations now possess and use data processing in order to determine, predict and influence individual behavior in all fields of human activity. This inevitably entails new risks, from the perspective of individual privacy, but also other fundamental rights, such as the right not to be discriminated against, fair competition between commercial enterprises and the proper functioning of democratic institutions. These phenomena have not been ignored from a legal point of view: at the national, supranational and international levels, an increasing number of regulatory instruments – including the European Union’s General Data Protection Regulation applicable as of 25 May 2018 – have been adopted with the purpose of preventing personal data misuse. Nevertheless, distinct national approaches still prevail in this domain, notably those that separate the comprehensive and detailed protective rules adopted in Europe since the 1995 Directive on the processing of personal data from the more fragmented and liberal attitude of American courts and legislators in this respect. In a globalized world, in which personal data can instantly circulate and be used simultaneously in communications networks that are ubiquitous by nature, these different national and regional approaches are a major source of legal conflict.

Ces progrès offrent des aperçus inattendus d'ordre épidémiologique, biologique mais aussi clinique ou thérapeutique qui s'ouvrent à la faveur de la statistique médicale. La médecine n'en devient que plus ambitieuse mais, en contrepartie, c'est une véritable révolution intellectuelle que les établissements doivent affronter. Cette nouvelle médecine, aujourd'hui à l'état d'ébauche, sera pour tous de manière évidente organisée et coordonnée autour du dossier médical partagé. A terme, le dossier médicale doit devenir le maillon clé du système d'information de santé, véritable réseau de soins partageable entre les différents professionnels de santé. Un des moyens privilégiés dont dispose l'hospitalisation privée pour "sortir de ses murs" est de s'intégrer dans des réseaux dont il faut aujourd'hui définir les éléments. Mais ceci augmente encore le risque de voir ces données utilisées à mauvais escient et de porter préjudice au patient, confronté à une information de plus en plus pointue qui rend difficile la transmission vers des personnes profanes. La problématique est complexe et les intervenants sont multiples. On peut cependant obtenir une vision d'ensemble de la protection juridique existante que ce soit dans le domaine de la santé ou dans le domaine, plus technique, de l'informatique. Cette étude, réalisée dans le cadre d'un contrat CIFRE sous un angle très pratique et pluridisciplinaire permet de s'apercevoir que l'application du droit médical au quotidien peut être plus aléatoire et bien plus difficile qu'il n'y paraît au premier abord.
