Book excerpt: L'animal, être vivant et sensible, peine aujourd'hui à trouver sa place dans le système juridique français. Protégé pour lui-même en droit pénal, il reste qualifié de chose mise au service de l'homme par le droit civil. Cette réification civiliste de l'animal semble cependant peu à peu dépassée : la question de la qualification juridique de l'animal est régulièrement mise en avant, tant par la doctrine que par le législateur. Pourtant, il semble que la difficulté résultant de la place de l'animal dans le système juridique français ne provienne pas directement de sa qualification juridique mais plutôt des droits applicables sur celui-ci. En effet, l'application du droit de propriété sur l'animal ne permet pas de le prendre en considération autrement que comme moyen mis au service de l'homme. Il est d'ailleurs contradictoire de considérer que l'animal est un être vivant et sensible, juridiquement protégé, et qu'il doit être soumis à un droit organisant des prérogatives directes et absolues en faveur de l'homme. Partant de ce constat, l'auteur tente de démontrer que l'application du droit de propriété sur l'animal est non seulement une source d'incohérences juridiques mais encore un frein à sa protection. Cela justifie qu'il convienne d'opérer la " désappropriation " de l'animal, en abolissant l'application du droit de propriété sur celui-ci. La soustraction de l'animal à sa qualité d'objet d'un droit de propriété remettrait cependant en cause la réification actuelle de l'animal et les droits conférés à l'homme sur celui-ci. C'est pourquoi la démarche de désappropriation de l'animal ne peut se contenter de pointer les lacunes du système actuel, ou d'envisager les mesures qui permettraient de l'améliorer, mais doit conduire à repenser la place de l'animal dans le droit français. La désappropriation de l'animal offrirait l'opportunité de faire table rase du passé et de repartir sur des bases nouvelles afin de reconstruire un statut juridique propre à celui-ci. Dans cette perspective, l'auteur propose les moyens de réaliser cette désappropriation en envisageant une réorganisation complète des rapports de l'homme et de l'animal autour d'une réflexion relative à la condition juridique adéquate de ce dernier dont dépendront les droits que l'homme peut exercer sur lui. Il tente alors d'imaginer un système d'organisation harmonieux, permettant de concilier les différents intérêts en présence, où l'homme détiendrait des droits sur l'animal en corrélation avec les droits de l'animal lui-même. La réalisation de la désappropriation, par la construction de ce nouveau système, aboutit en conclusion à la proposition d'un Code de l'animal.
