Book excerpt: Le droit des étrangers est en plein essor sous l'influence des normes supranationales (traités, conventions, droit de la CEDH, etc.) et notamment du droit communautaire (directives et règlements communautaires). Cette étude porte sur l'influence de ces normes qui participent directement ou indirectement à la mutation du statut interne de l'étranger. On assiste à l'émergence d'un régime migratoire supranational. La Convention de Genève, les accords bilatéraux mais surtout la politique communautaire de l'asile et d'immigration font émerger un véritable statut supranational pour l'étranger. Cette recherche permet notamment de mesurer le degré de communautarisation du statut interne de l'étranger ordinaire mais aussi celui du demandeur d'asile. L'entrée, le séjour et la sortie de l'étranger et du demandeur d'asile sont régis par ces nouvelles normes. Parallèlement à ce phénomène de communautarisation, le droit interne connaît une montée en puissance des droits internationaux des droits de l'Homme. De ces différentes normes et jurisprudences internationales, se dégage un ensemble de droits et libertés protecteurs pour l'étranger. Ces garanties supranationales viennent donc compléter le statut interne de l'étranger. Ces différentes garanties n'ont pas le même effet sur le statut de l'étranger. Si certaines assurent une fonction de " correction " dans le statut interne, c'est à dire qu'elles améliorent le statut interne en accentuant une protection déjà existante dans le statut de l'étranger, d'autres, au contraire, ont une fonction " innovante " puisqu'elles apportent des garanties jusqu'ici inédites dans le statut interne de l'étranger.

Book excerpt: An important provision of the European Convention on Human Rights is that in the event of a violation being found, not only is the state in question required to redress the consequences of the violation vis-á-vis the applicant - by such means as reopening of proceedings at the origin of the violation, reversal of a judicial verdict, discontinuation of expulsion proceedings or, where necessary, payment of a monetary award to the applicant; but it must also take general measures to prevent the repetition of the violation. These latter measures may take the form, for example, of a change in legislation, recognition of the Court's judgment in national case-law, the appointment of extra judges or magistrates to absorb a backlog of cases, the construction of detention centres suitable for juvenile delinquents, the introduction of training for the police, or other similar steps. In that same vein, the paradigm proposed by Ms. Van Lith ought to shift to special grounds of jurisdiction based on sufficient connection between the defendant and the forum state. In that respect, she proposes jurisdiction at the place where the defendant has a fixed place of business from which he carries out business activities directly related to the claimant’s contractual claim. Absent such a place of business, jurisdiction is to be vested in the courts of the country where the defendant is engaged in substantial business activities in relation to the contract with a limited forum shopping for a claimant in favour of the court of the defendant’s home country. Other general or special grounds for jurisdiction (such as claimant-related connections or property-based connections) are rejected because they do not meet the proposed paradigm of sufficient connection. As to exceptions to international jurisdiction rules as proposed, Ms. Van Lith comes to the conclusion that a general escape provision is to be avoided except for the ‘tra- acting business’ rule where – in accordance with the paradigm proposed – international jurisdiction can be avoided in favour of the defendant’s home court when the dispute is insufficiently connected with the forum making it unfair under the circumstances to expect the defendant to be subjected to the jurisdiction of that court. In this respect, a balanced approach to predictability and flexibility is being proposed.
