Dans un premier temps c'est la loi du 13 juillet 1992 qui a traduit la volonté de maîtriser la progression constante du volume des déchets. Par des prescriptions de ce texte, la France a donc été priée de rentrer dans une ère nouvelle de la gestion des déchets reposant sur une maîtrise complexe s'appuyant sur les agents économiques, devant traiter une grande variété de déchets grace à divers types de collecte ainsi que sur de nombreux dispositifs de traitement. Cependant, les objectifs initiaux prévus par la loi de 92 ont vite atteint leurs limites. C'est pourquoi la directive européenne du 19 novembre 2008 et le Grenelle de l'Environnement prennent aujourd'hui le relai de ce dispositifen imposant une nouvelle hiérarchisation dans le traitement du déchet. La réduction à la source prend dès lors un aspect primordial et passe désormais par la prévention. La nouvelle philosophie générale veut alors que l'on passe du "trier plus" actuel au "jeter moins" de demain avec la nécéssité de modifier les attitudes comportementales de chacun vers l'éco-conception. Par ailleurs, si l'avenir de la gestion des déchets est devenue un problème d'intérêt public, sa nécessité de les valoriser et de les recycler fait l'objet d'un consensus national. Mais la réalisation de ces objectifs engendre désormais de forts investissements du fait de la création d'infrastructures lourdes, génératrices également de retombées financières importantes par le biais de la valorisation et des différents modes de recyclages.

Son élaboration passe par une concertation qui doit être la plus large possible, dans la mesure où le plan est un document qui doit être accepté par tous et non imposé par l'Etat (première partie). La mise en application des dispositions des plans suppose par ailleurs une nouvelle forme d'intercommunalité, plus élargie, mieux adaptée aux objectifs fixés par la loi du 13 juillet 1992. Cette coopération intercommunale doit permettre en autre de relever ce défi financier que constitue, dans chaque département, la modernisation de la gestion des résidus urbains. La mise en œuvre des plans d'élimination revêt ainsi des incidences d'ordre économique et institutionnel (deuxième partie).
