Le droit sur la marque est un droit d'occupation résultant de l'appropriation d'un signe pour désigner les produits ou services. La marque attribue à son titulaire un droit exclusif d'exploitation opposable à tous. L'octroi de ce droit exclusif peut porter atteint à la liberté de la concurrence puisque le tiers est interdit d'adopter le signe constituant la marque pour désigner ses produits ou services similaires à ceux du titulaire. Pour concilier l'intérèt antagoniste du titulaire bénéficiant du monopole d'exploitation de la marque et du concurrent disposant de la liberté du commerce et de la concurrence, l'appropriation du signe par le droit des marques est soumise à des conditions de validité et des procédures d'enregistrement assez strictes. Celles-ci sont similaires en droit Cambodgien et Français. L'étude détaillée sur cette similarité doit ainsi ètre abordée à fin de trouver les points forts et les points faibles dans les deux droits.
