Book excerpt: The family can be viewed as one of the links in a “golden chain” connecting individuals, the private sphere, civil society, and the democratic state; as potentially an important source of energy for social activity; and as the primary institution that socializes and diffuses the values and norms that are of fundamental importance for civil society. Yet much of the literature on civil society pays very little attention to the complex relations between civil society and the family. These two spheres constitute a central element in democratic development and culture and form a counterweight to some of the most distressing aspects of modernity, such as the excessive privatization of home life and the unceasing work-and-spend routines. This volume offers historical perspectives on the role of families and their members in the processes of a liberal and democratic civil society, the question of boundaries and intersections of the private and public domains, and the interventions of state institutions.

Available in PDF, EPUB and Kindle. Book excerpt: This volume presents global and comparative perspectives on the perpetual pendular movement of family law between status and contract. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.

Book excerpt: The advent of satellite television and its adoption in the Maghreb brought about a profound social change. This book, which explores the relationships between the media and the public sphere, shows that the simple and quotidian act of watching satellite television as opposed to national television mobilizes novel ways of expressing identities along with a range of critical positions targeting political regimes. By bringing certain topics hitherto hardly present to the center of homes, the media reveals the pivotal functions of gender relations, which are today at the heart of social and political matters in Algeria, Morocco and Tunisia. Based on extensive fieldwork, this book offers a unique interpretation of the use of satellite television in authoritarian contexts and contributes to a better understanding of the media and the political public sphere. The book will interest teachers and students in communication, political studies, gender studies, sociology and anthropology of the Arab worlds and the Mediterranean.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the ambiguities of the French law of genocide by exposing the inexplicable dichotomy between a progressive theory and an overly conservative practice. Based on the observation that the crime of genocide has remained absent from French courtrooms to the benefit of crimes against humanity, this research dissects the reasons for this absence, reviewing and analysing the potential legal obstacles to the judicial use of the law of genocide before contemplating the definitional impact of this judicial reluctance and the consequent confusion between the two crimes. Whilst it uses the French law of genocide and related case law on crimes against humanity as its focal points, the book further adopts a more general standpoint, suggesting that the French misunderstandings of the crime of genocide might ultimately be symptomatic of a more widespread misconception of the crime of genocide as a crime perpetrated against 'a group'.

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

These 21 papers are a key selection of the papers presented there, with an introduction by the distinguished historian Bahru Zewde. Given the contemporary salience and the historical depth of the issue of identity, the congress was devoted to that global phenomenon within Africa. The papers explore and analyse the issue of identity in its diverse temporal settings, from its pre-colonial roots to its cotemporary manifestations. The papers are divided into six parts: Pre-Colonial Identities; Colonialism and Identity; Conceptions of the Nation-State and Identity; Identity-Based Conflicts; Migration and Acculturation; and Memory, History and Identity. The authors are scholars from Benin, Botswana, Cameroon, the Democratic Republic of Congo, Ethiopia, Mali, Nigeria, Senegal, South Africa and Zimbabwe. Bahru Zewde is Emeritus Professor of History at Addis Ababa University, Executive Director of the Forum for Social Studies, and Vice-President of the Association of African Historians. He was formerly Chairperson of the Department of History and Director of the Institute of Ethiopian Studies at Addis Ababa University. Amongst his publication is A History of Modern Ethiopia 1855-1991.

Available in PDF, EPUB and Kindle. Book excerpt: This volume explores the process of heritage making and its relation to the production of touristic places, examining several case studies around the world. Most existing literature on heritage and tourism centers either on its managerial aspects, the tourist experience, or issues related to inequality and identity politics. This volume instead establishes theoretical links between analyses of heritage and the production and reproduction of places in the context of the global tourist trade. The approach adopted here is to explore the production of heritage as a complex process shaped by local and global discourses that can have a deep impact on several policies and legislations. Heritage itself has now become not only a global discourse, but also a global practice, which may eventually lead to the use of heritage as a field for hegemony. From these perspectives, heritage making may be incorporated in the world economy, mainly through the global tourism trade. The chapters in this book stress the need for identifying the intrinsic political implications of these processes, relocating their study in political, economic and social settings. Combined with a diversified set of theoretical approaches and research methods, guided by a common thematic rationale, The Making of Heritage is at the forefront of current debates about heritage.
