Book excerpt: This book assesses the Statute for a European Cooperative Society (SCE) regarding agricultural activities by comparing how specific questions arising in this context must be dealt with under the Italian and Austrian legal systems. In this regard, Council Regulation (EC) No. 1435/2003, of 22 July 2003, on the Statute for a European Cooperative Society (SCE), is used as a tool for the structured analysis of various aspects of agricultural cooperatives. However, a comparison is only meaningful if the results are made comparable on the basis of a previously defined standard. Accordingly, the study uses, on one hand, a cooperative model developed by European legal scholars that defines general guidelines on how cooperatives should function (PECOL). On the other, the results are presented in connection with economic considerations to discuss how efficient rules can be developed.

La trattazione si sviluppa attraverso una combinazione ponderata del metodo casistico – applicato, anche ed in particolare, premettendo ad ogni capitolo l’analisi approfondita di un caso e della/e relativa/e decisione/i – e di quello sistematico-ricostruttivo, privilegiando, comunque, un approccio diretto alle fonti ed ai formanti di ciascun ordinamento, che vengono messi a disposizione del lettore in modo ragionato, ma sempre, ove possibile e ritenuto utile, nell’espressione linguistica originale, in modo da stimolare lo sviluppo di un’autonoma capacità di analisi. L’opera giunge, alfine, a tratteggiare i contorni di una prospettiva, ad un tempo nuova ed antica, nella soluzione dell’eterno dilemma tra diritto e giustizia.

In this book, academics and practitioners provide the first in-depth overview of research and practice in GBV in universities. They set out the international context of ideologies, politics and institutional structures that underlie responses to GBV in elsewhere in Europe, in the US, and in Australia, and consider the implications of implementing related policy and practice.
