Le droit et l'économie ne constituent pas en effet deux univers indépendants ou opposés, les rapports économiques s'exprimant à travers les règles juridiques qui les légitiment. Le droit public économique est caractérisé par son fondement (l'intervention économique des personnes publiques avec des prérogatives de puissance publique) et son étendue puisqu'il fait appel à toutes les branches du droit public : droit international et droit communautaire, droit constitutionnel, finances publiques et droit fiscal, droit administratif. Il a contribué à dégager des solutions nouvelles en enrichissant le droit public, mais sa finalité est différente : il ne s'agit pas de régir une fois pour toutes les relations entre différents sujets de droit, mais d'exercer une influence sur le comportement des agents économiques, ce qui oblige à prendre en considération leurs besoins et leurs aspirations et à s'adapter aux fluctuations de la vie économique. L'ouvrage s'ordonne autour des deux types d'interventionnisme public et donc des deux branches du droit public économique : - l'interventionnisme de gestion industrielle et commerciale qui se manifeste par l'intermédiaire des entreprises publiques ; - l'interventionnisme de régulation de l'économie globale, où la puissance publique réglemente les activités économiques (production, répartition, consommation de biens et services). Cette deuxième branche regroupe les règles autour des pôles qui constituent la politique économique à moyen terme, visant à réaliser les grands objectifs tels que l'orientation des investissements, la stabilité des prix, l'équilibre de la balance des paiements, le respect des règles de la concurrence, la stabilité monétaire, l'aménagement du territoire. Appuyé sur une vaste bibliographie et la jurisprudence la plus récente, cet ouvrage offre ainsi une synthèse claire et novatrice du droit public économique français et de son évolution à travers le droit communautaire.

In contrast, cities like the Qatari capital Doha still appear to be heavily ’under construction’ and in countries like the Sultanate of Oman, ultra-luxury tourism projects were started only recently. While the construction of artificial islands, theme parks and prestige sport facilities has attracted considerable attention, much less is known about the region’s widespread implementation of innovative infrastructure such as global container ports, free zones, inter-island causeways and metro lines. This volume argues that these endeavours are not simply part of a strategy to prepare for the post-oil era for future economic survival and prosperity in the Lower Gulf region, but that they are also aiming to strengthen identitarian patterns and specific national brands. In doing so, they exhibit similar, yet remarkably diverse modes of engaging with certain global trends and present - questionably - distinct ideas for putting themselves on the global map.
