Book excerpt: Thisbook is the fruit of a number of years of assimilating another culture and learning about the evolution of its institutions, altogether an incr- iblyrich andrewarding experience. Ihopetopassonto the reader some of that richness in the belief that, even in a “globalizing” context, learning about other nations and cultures is more and more necessary. The reasons andvalues behind this belief are perhaps evident, but I amconvincedthat they bear repeating here. To begin with, the hasty generalizations that often liebehind the cynicism—and ultimately the violence—of ethnocentrism and xe- phobia are still being aired today and still need to be fought, even in “unified and advanced” regions of the world like Europe and the United States. The historical and social sciences disciplines need to be solicited constantly in this combat, even though they themselves are terrains of controversy and contestation. I personally have not lost faith in their “progressive” potential and character. Second, my belief is that only through this process of appeal to these disciplines and their findings can we resist a dangerous contemporary slide into simplisticand sensation- ist pictures of the world—viewpoints often associated with an implicit assumption that social and economic change are linear processes, so- how unfolding according to the same neat “logic” wherever they are at work.

Available in PDF, EPUB and Kindle. Book excerpt: Labour law has always been preoccupied with boundaries. One can either be an 'employee' or not, an 'employer' or not, and the answer dictates who comes within the scope of labour law, for better or worse. But such divisions have always been difficult, and in recent years their shortcomings have become ever more pronounced. The proliferation of new work arrangements and heightened global competition have exposed a world-wide crisis in the regulation of work. It is therefore timely to re-assess the idea of labour law, and the concepts, in particular the age-old distinctions - that are used to delimit the field. This collection of essays, by leading experts from around the world, explores the frontiers of our understanding of labour law itself. Contributors: Harry Arthurs, Paul Benjamin, Hugh Collins, Guy Davidov, Paul Davies, Simon Deakin, Mark Freedland, Judy Fudge, Adrin Goldin, Alan Hyde, Jean-Claude Javillier, Csilla Kollonay Lehoczky, Brian Langille, Enriqué Marin, Kamala Sankaran, Silvana Sciarra, Katherine Stone and Anne Trebilcock.

Book excerpt: The accession by the European Union to the European Convention on Human Rights (ECHR) has opened up new possibilities in terms of the constitutional recognition of fundamental rights in the EU. In the field of employment law it heralds a new procedure for workers and trade unions to challenge EU law against the background of the ECHR. In theoretical terms this means that EU law now goes beyond recognition of fundamental rights as mere general principles of EU law, making the ECHR the 'gold standard' for fundamental (social) rights. This publication of the Transnational Trade Union Rights Working Group focuses on the EU and the interplay between the Strasbourg case law and the case law of the Court of Justice of the European Union (CJEU), analysing the relevance of the ECHR for the protection of workers' rights and for the effective enjoyment of civil and political rights in the employment relation. Each chapter is written by a prominent European human rights expert and analyses the case law of the European Court of Human Rights (ECtHR), and also looks at the equivalent international labour standards within the Council of Europe (in particular the (Revised) European Social Charter), the International Labour Organization (ILO) (in particular the fundamental rights conventions) and the UN Covenants (in particular the International Covenant on Economic, Social and Cultural Rights) and the interpretation of these instruments by competent organs. The authors also analyse the ways in which the CJEU has acknowledged the respective ECHR articles as 'general principles' of EU law and asks whether the Lisbon Treaty will also warrant a reassessment of the way it has treated conflicts between these 'general principles' and the so-called 'fundamental freedoms'.

Book excerpt: TECHNOLOGICAL CHANGES AND HUMAN RESOURCES SET Coordinated by Patrick Gilbert The accelerating pace of technological change (AI, cobots, immersive reality, connected objects, etc.) calls for a profound reexamination of how we conduct business. This requires new ways of thinking, acting, organizing and collaborating in our work. Faced with these challenges, the Human and Social Sciences have a leading role to play, alongside others, in designing, supporting and implementing these digital transformation projects. Their ambition is to participate in the development of innovative and empowering devices, that is to say, systems that are truly at the service of human beings and their activity, that empower these professionals to take action and that also provide occupational health services. This book takes a multidisciplinary look at the challenges of these digital transformations, making use of occupational psychology, ergonomics, sociology of uses, and management sciences. This viewpoint also helps provide epistemological, methodological and empirical insights to better understand and support the changes at work.

Book excerpt: A provocative investigation of how law shapes everyday life In this groundbreaking work, French legal scholar Alain Supiot examines the relationship of society to legal discourse. He argues that the law is how justice is implmented in secular society, but it is not simply a technique to be manipulated at will: it is also an expression of the core beliefs of the West. We must recognize its universalizing, dogmatic nature and become receptive to other interpretations from non-Western cultures to help us avoid the clash of civilizations. In Homo Juridicus, Supiot deconstructs the illusion of a world that has become “flat” and undifferentiated, regulated only by supposed “laws” of science and the economy, and peopled by contract-makers driven only by the calculation of their individual interests. Such a liberal perspective is nothing but the flipside of the notion of the withering away of law and the state, promoted this time not under the banner of the struggle between classes, but rather in the name of the free competition between sovereign individuals. Supiot’s exploration of the development of the legal subject—the individual as formed through a dense web of contracts and laws—is set to become a classic work of social theory.

Available in PDF, EPUB and Kindle. Book excerpt: This was first published in 2000: This work is founded on the premise that many analyses of economic restructuring and of gender relations fail to recognize two things. First, the situation facing women is different from that of the 1960s when the conceptual apparatuses for analyzing "women and work" were created. Labour markets are dominated by flexible, non-standard work, precarious contractual relations and income disparities. Therefore, it is difficult to structure political claims or analysis around the notion that there is a single labour market, that the primary problem is discrimination or inappropriate training, and that political strategies should focus on discrimination and non-traditional employment. Rather, new challenges require new solutions. The second point of departure is that is is impossible to understand either contemporary labour markets, or the roots of employment and other public policies without locating them vis a vis patterns of gender inequalities generated by and in these labour markets. The labour force has been feminized to such an extent that new, and often unequal gender relations are crucial to their very functioning.

In a changing global economy, work - as the activity that structures individuals in capitalism both socially and psychologically - is being undermined. Combining a Gramscian critique of contemporary patterns of capitalist labour control with Lacanian psychoanalysis, Durand examines what kinds of human beings are emerging in and through modern work, or on its margins. Creating the New Worker will be of interest to students and scholars who engage in the sociology and psychology of work, economics, and labour.
