Est d’abord dressé pour chaque mode de transport un panorama des sources dans une perspective à la fois historique et prospective. Puis viennent les questions essentielles de l’évolution des contrats et des responsabilités : l’influence des contraintes économiques, environnementales et sociales ainsi que du souci de « développement durable », l’apparition de nouveaux contrats liés à la globalisation de la demande, les spécificités de la responsabilité selon que l’on est en transport de passagers ou de marchandises. Sont enfin abordés quelques aspects de la réglementation sociale du transport : conditions de travail, risque pénal. Le droit européen imprègne toujours plus la matière car il existe une politique commune des transports (art.70 à 80 tCe). une bonne dizaine de directives et de règlements ont été adoptés depuis 2000 notamment dans les domaines de l’accès à la profession, des conditions de travail, de la sécurité et de la sûreté, des droits des passagers et de la responsabilité. Cet ouvrage est aussi l’occasion de mettre en lumière à la fois cette réalité, ainsi que l’influence du droit européen sur le droit interne et, partant, le monde du transport et de la logistique.
