L'utilisation de l'eau pose le problème du partage de l'eau et les litiges sont à régler dans le cadre du droit international. En plus, le partage de l'eau est sujet aux affinités et intérêts politiques dans les relations régionales. Il est un facteur dans la stratégie de la réalisation de la sûreté nationale, en considérant que les conceptions légales actuelles se concentrent sur la solution des problèmes du partage des eaux communes par l'encouragement à trouver des formules de coopération entre les pays du bassin de manière équilibrée et raisonnable et ne pas causer de préjudice aux cours d'eau ou au reste des pays qui font partie du bassin. Les dimensions légales s'entremêlent avec les facteurs politiques affectant ainsi les relations internationales. La majorité des pays de la région étant musulmans, donc les règles islamiques relatives au droit de partage et de l'utilisation de l'eau ressemblent à la règle du droit international dans ce domaine, ce qui peut régler le problème de manière équitable et raisonnable sans causer de préjudice. C'est le résultat auquel est arrivée la communauté internationale par l'adoption de l'ONU la convention-cadre de 1997, qui est considérée comme la référence la plus importante relative au partage de l'eau douce.
