Book excerpt: Au début du processus de construction de l'acte uniforme relatif au droit des sociétés coopératives, le but du législateur OHADA était d'élaborer des règles devant régir non seulement les sociétés coopératives, mais également les mutuelles. Toutefois, entre 2004 et 2007, de vives discussions ont eu lieu et ont abouti à l'exclusion du droit des mutuelles. Le 15 décembre 2010, l'OHADA a adopté un acte uniforme relatif uniquement au droit des sociétés coopératives. L'objectif de cette recherche est de critiquer ce retrait du droit des mutuelles, tout en plaidant pour une reconsidération d'un acte uniforme relatif au droit des sociétés coopératives et mutualistes. Le droit des mutuelles reste marginalisé et manque d'identité et d'unité. De même, les coopératives et les mutuelles partagent beaucoup de convergences et des recherches de terrain montrent qu'elles peuvent engager des complémentarités utiles : d'où l'idée d'envisager un traitement conjoint des règles régissant ces deux formes juridiques d'organisation. L'élaboration d'un acte uniforme relatif au droit des sociétés coopératives et mutualistes présente l'avantage de poser les jalons d'un droit des organisations de l'économie sociale et solidaire.

Based on a dialogue between the Court of Justice and national courts, it is strictly linked to the protection of the rights that individuals derive from EU law. This book focuses on this procedure from the perspective of the right to effective judicial protection, in light of Article 19(1), second subparagraph, TEU and Article 47 of the Charter of Fundamental Rights of the EU. It explores the level of protection that is ensured to individuals in order to access to the Court of Justice through preliminary references on the validity of EU acts and on the interpretation of EU law.
