Book excerpt: This book presents a broad overview of succession law, encompassing aspects of family law, testamentary law and legal history. It examines society and legal practice in Europe from the Middle Ages to the present from both a legal and a sociological perspective. The contributing authors investigate various aspects of succession law that have not yet been thoroughly examined by legal historians, and in doing so they not only add to our knowledge of past succession law but also provide a valuable key to interpreting and understanding current European succession law. Readers can explore such issues as the importance of a father’s permission to marry in relation to disinheritance, as well as inheritance transactions and private, dynastic and cross-border successions. Further themes addressed by the expert contributors include women’s inheritance rights, the laws of succession for the prince in legal consulting, and succession in the Rota Romana’s jurisprudence.

Available in PDF, EPUB and Kindle. Book excerpt: The Impact of Institutions and Organisations on European Family Law looks at the impact that institutions and organisations have had, and continue to have, on European family law. In many ways the chapters in this volume provide the easiest explanation for the existence of a European family law. While there is no European body that could actually legislate definitively on family law – even the European Union has no such mandate – there are still some obvious institutions that have a very direct impact on European family law. These can be divided into two groups; namely those that have a direct impact, such as the European Court of Human Rights and the European Union, and those that have an indirect impact, such as the Commission on European Family Law (CEFL), the Council of Europe and the International Commission on Civil Status (ICCL/CIEC) as well as the private international law instruments of the Hague Conference (HCCH) and the EU. Together, with religion, all of these institutions are contributing to the creation of a European family law. This book, and the others in the set, will serve as an invaluable resource for anyone interested in family law. It will be of particular use to students and scholars of comparative and international family law, as well as family law practitioners.

Book excerpt: Through his research on the status of women in Florence and other Italian cities, Julius Kirshner helped to establish the socio-legal history of women in late medieval and Renaissance Italy and challenge the idea that Florentine women had an inferior legal position and civic status. In Marriage, Dowry, and Citizenship in Late Medieval and Renaissance Italy, Kirshner collects nine important essays which address these issues in Florence and the cities of northern and central Italy. Using a cross-disciplinary approach that draws on the methodologies of both social and legal history, the essays in this collection present a wealth of examples of daughters, wives, and widows acting as full-fledged social and legal actors. Revised and updated to reflect current scholarship, the essays in Marriage, Dowry, and Citizenship in Late Medieval and Renaissance Italy appear alongside an extended introduction which situates them within the broader field of Renaissance legal history.

Available in PDF, EPUB and Kindle. Book excerpt: With marriage in decline, divorce on the rise, the demise of the nuclear family, and the increase in marriages and adoptions among same-sex partners, it is clear that the structures of kinship in the modern West are in a state of flux. In The Metamorphoses of Kinship, the world-renowned anthropologist Maurice Godelier contextualizes these developments, surveying the accumulated experience of humanity with regard to such phenomena as the organization of lines of descent, sexuality and sexual prohibitions. In parallel, Godelier studies the evolution of Western conjugal and familial traditions from their roots in the nineteenth century to the present. The conclusion he draws is that it is never the case that a man and a woman are sufficient on their own to raise a child, and nowhere are relations of kinship or the family the keystone of society. Godelier argues that the changes of the last thirty years do not herald the disappearance or death agony of kinship, but rather its remarkable metamorphosis-one that, ironically, is bringing us closer to the "traditional" societies studied by ethnologists.

The "Hague Yearbook" contains in-depth articles on these developments and summaries of (aspects of) decisions rendered by the International Court of Justice, the Permanent Court of Arbitration and the Iran-United States Claims Tribunal. Book excerpt: Canon law touched nearly every aspect of medieval society, including many issues we now think of as purely secular. It regulated marriages, oaths, usury, sorcery, heresy, university life, penance, just war, court procedure, and Christian relations with religious minorities. Canon law also regulated the clergy and the Church, one of the most important institutions in the Middle Ages. This Cambridge History offers a comprehensive survey of canon law, both chronologically and thematically. Written by an international team of scholars, it explores, in non-technical language, how it operated in the daily life of people and in the great political events of the time. The volume demonstrates that medieval canon law holds a unique position in the legal history of Europe. Indeed, the influence of medieval canon law, which was at the forefront of introducing and defining concepts such as 'equity,' 'rationality,' 'office,' and 'positive law,' has been enormous, long-lasting, and remarkably diverse.

Available in PDF, EPUB and Kindle. Book excerpt: What does well-being mean when we talk about men and women in the past? Their sheer chances of survival, their protection from want, their social status, their individual agency and their self-esteem were all strongly mediated by the family, the predominant social institution. Family laws and customs of family formation created differences between insiders and outsiders in terms of well-being. Within families, there were strong differences in autonomy, status and freedom between the genders and generations. The book offers a fascinating exploration of gender differences in well-being in many regions of historic Europe, with some comparative perspectives. It explores how historic family systems differed with respect to choosing a marriage partner, transmitting property, living and care conditions of widows and widowers and the position of children born out of wedlock.
