Le droit positif affecte aux autorités étatiques des attributs subjectifs, autrement dit, des droits et obligations vis-à-vis d'autrui. Malgré son utilisation généralisée dans les textes, la jurisprudence et la doctrine, le concept d'Etat sujet de droit interne est relativement peu étudié. Cette lacune est particulièrement sensible en ce qui concerne la situation de l'Etat vis-à-vis du juge national car elle contraste avec le succès de la notion d'Etat de droit. Cette notion promeut l'assujettissement des pouvoirs publics au respect du droit et au contrôle du juge. Selon une présentation commune, l'Etat de droit implique que l'Etat soit considéré comme une personne morale dont les décisions sont soumises au respect du principe de légalité, à l'instar des autres personnes juridiques. Cette proposition mérite d'être appréciée au regard du droit positif. Cette thèse appréhende la situation de l'Etat français en tant que sujet du droit processuel commun. Elle examine la situation de toutes les autorités étatiques habilitées à agir devant les juridictions administratives et judiciaires. Le ministère public judiciaire est inclus dans le champ d'étude afin de saisir l'ensemble des principes et concepts qui définissent et structurent la relation subjective de l'Etat aux juridictions internes. L'analyse est portée sur les sources et le statut du droit d'agir en justice de l'Etat, d'une part, et d'autre part, sur les règles de procédure applicables aux autorités étatiques parties au procès administratif et judiciaire. Cette perspective permet d'apprécier la portée du principe de justiciabilité de l'Etat et les limites de son assimilation aux personnes juridiques ordinaires. Elle révèle également la complexité du lien juridique entre la figure de l'Etat sujet de droit et le citoyen bénéficiaire de droits fondamentaux. Par suite, elle renouvelle la perception théorique de l'Etat et de ses différentes déclinaisons juridiques, telle que la figure de l'Etat souverain.

Book excerpt: Dans le cadre de l'examen du droit d'agir, l'intérêt à agir est la condition de l'action selon laquelle le justiciable est à même de tirer un avantage du procès. Mais cette connotation substantielle accentuée par l'exigence controversée de la légitimité de l'intérêt à agir est de nature à contrarier, au nom de la légalité, la logique d'une chronologie de la technique procédurale. En effet, il est difficile d'examiner cette légitimité sans faire intervenir le fond du droit ; et ceci, au détriment du principe de la séparation procédurale de l'examen de la recevabilité de celui du fond du droit en discussion. Le débat est vieux mais persiste encore aujourd'hui en dépit des solutions proposées par la doctrine. Il était question dans la présente étude de réfléchir sur l'influence de cette situation sur le processus d'adjudication judiciaire du droit en discussion. Ce débat suggère une réforme du code de procédure civile : détacher l'examen de la légitimité de l'intérêt de cette étape de la recevabilité ; puis, le rattacher à l'examen au fond du droit, son champ normal d'existence dans le parcours judiciaire. On parlerait alors de la légitimité du droit. Aussi, pourra-t-on procéder a la redéfinition de la notion d'action en la prenant, non plus comme un droit, mais plutôt comme une voie en vue de l'effectivité du droit, tel un moyen, un moyen parmi tant d'autres.

The damages are often dispersed and low-level. As a result, the private enforcement gap has deepened and collective redress represents an interesting procedural instrument that is able to provide effective access to justice. This book analyses thoroughly the dominant collective redress models adopted in the EU. Data from 13 Member States has been catalogued and categorised. The research mainly focuses on the consumer law field but frequent references to financial and data protection-related cases are made. The dominant collective redress models are then studied from a private international law perspective. In particular, the book highlights the current mismatch between collective redress on the one hand, and rules on international jurisdiction on the other. For this reason, the solutions found by the judge to the various problems arising from the application of the Natura 2000 provisions in the different Member States deserve attention and will be rewarding for both researchers and practitioners.
