Or, celui-ci se développe dans tout le système juridique et le droit d'auteur ne peut l'ignorer, d'autant que le droit à l'information contribue à donner une nouvelle définition du public. L'on comprend rapidement la relation complexe et conflictuelle entre les deux concepts, l'un prônant la liberté alors que l'autre engendre des situations de monopoles. Il est donc nécessaire de rechercher un équilibre pour que le droit à l'information comme le droit d'auteur puissent être satisfaits. Cette recherche s'effectuera d'abord sous l'angle du droit d'auteur en tentant de résoudre le conflit avec les instruments connus par celui-ci. Or, cette recherche s'avérant insatisfaisante, il conviendra de l'effectuer sous l'angle du droit à l'information qui se révèlera être beaucoup plus satisfaisante.

Il existe entre ces deux droits une tension qui se retrouve aussi bien au sein des principes qui fondent le droit d'auteur que par sa concrétisation par le droit positif. En effet, dès son origine le droit d'auteur est considéré en partie comme un moyen de garantir la libre diffusion des idées au sein du corps social. Loin d'être un droit égoi͏̈ste, le droit d'auteur est un droit imprégné d'une importante fonction sociale qui justifie dans une large mesure sa raison d'être. Le droit du public à l'information trouve d'ailleurs sa concrétisation à travers les limites de la protection du droit d'auteur, lesquelles permettent de réaliser un équilibre entre les différents intérêts en présence. Cependant, suite à une évolution récente, le champ de protection du droit a été démesurément étendu, ce qui a eu pour effet de remettre en cause cet équilibre.

S’il n’est pas acceptable que le droit d’auteur soit placé par ses adeptes dans un sanctuaire, la liberté d’expression ne doit pas non plus être sanctifiée, particulièrement à une époque où les revendications sous couvert de liberté d’expression sont souvent émises par des opérateurs commerciaux pour travestir des intérêts plus vénaux. Dès lors que ni le droit d’auteur, ni la liberté d’expression ne devraient par principe l’emporter, il reste - tâche plus ardue - à déterminer le juste équilibre. C’est à cette recherche d’un équilibre que les contributions rassemblées dans le présent volume sont consacrées. Certaines émanent de spécialistes du droit d'auteur, d’autres de juristes des droits de l'homme, parfois elles rassemblent les deux. Tous les auteurs réunis proviennent de pays partiellement francophones et le recueil offre une palette d’approches «civilistes» sur la relation entre droit d’auteur et liberté d’expression.
