Le présent rapport analyse des données sur la participation politique des personnes handicapées collectées dans les 28 États membres de l'Union européenne par l'Agence des droits fondamentaux de l'Union européenne (FRA) et le Réseau d'études européen d'experts dans le domaine du handicap (ANED), financé par la Commission européenne. Les indicateurs relatifs aux droits de l'homme figurant dans le présent rapport montrent que la présence d'obstacles juridiques et administratifs, des processus et des informations inaccessibles et une mauvaise connaissance des droits politiques peuvent empêcher les personnes handicapées de prendre part à la vie politique de leur communauté. La recherche révèle également l'absence de données fiables et comparables concernant les expériences de personnes handicapées ayant participé à des élections dans l'Union européenne. Il est crucial de s'attaquer au plus tôt à ces problèmes, afin de renforcer la légitimité des institutions publiques et de créer des sociétés plus équitables et inclusives, auxquelles tous les membres peuvent pleinement participer.

La protection englobe ici l'ensemble des mécanismes destinés à assurer une vie digne à la personne en situation de handicap, à garantir à celle-ci la plénitude et l'effectivité des prérogatives reconnues à tout être humain. Autant dire que le contenu de cet ouvrage issu d'un colloque organisé à Paris le 15 mars 2007 s'inscrit dans la démarche entreprise par l'Association Travail et Handicap dans la Recherche publique depuis 1986. Analysant les modèles proposés par l'ONU, l'Union européenne, le Conseil de l'Europe, le Maghreb et différents Etats, confrontant ces modèles les uns aux autres dans leurs dimensions théorique et pratique, les interventions rassemblées ici délivrent des informations qui remettent parfois en cause quelques idées reçues et proposent des solutions concrètes, utiles au chercheur, à la personne handicapée, au travailleur social. Si la première série de contributions de l'ouvrage s'attache à l'examen prospectif de la protection des personnes handicapées dans une approche globalisante, la seconde série se consacre particulièrement à la confrontation de l'emploi au handicap, laquelle commence par une analyse économique. Autant dire que les employeurs et les travailleurs handicapés se nourriront d'éléments dont certains sont en pleine évolution et évolueront encore, notamment sous l'influence de la convention des Nations Unies relative aux droits des personnes handicapées du 13 décembre 2006.

A travers lois, règlements ou conventions, les Etats ayant signé et ratifié cette convention établissent des politiques qui dessinent les orientations à suivre en faveur du développement de pratiques inclusives. Cependant, pour les personnes en situation de handicap, l’écart entre les lois et les pratiques peut s’avérer important tant les attitudes négatives, les préjugés, les lacunes dans l’organisation des services et les problèmes d’accessibilité sont lents à disparaître. Passer du principe à la réalité peut souvent sembler utopique. Pourtant, des initiatives citoyennes et scientifiques menées avec succès démontrent que l’émancipation des personnes avec une déficience intellectuelle est en marche et que l’autodétermination tend à devenir une réalité pour une partie croissante d’entre elles. Pour les enfants, on s'oriente vers une scolarisation plus inclusive, pour les adultes des dispositifs en vue d’une plus grande autonomie dans les choix de vie fondamentaux sont sporadiquement mis en place. Les contributions présentées dans cet ouvrage sont issues d’expériences de personnes concernées, de professionnel·le·s, de chercheur·e·s et d’étudiant·e·s de différents pays francophones (Suisse, France, Belgique, Canada) et offrent des pistes de réflexion et d’action en vue d’une concrétisation de l’égalité des droits.

Book excerpt: Le Laboratoire Interdisciplinaire sur les Echanges et la Norme (LIEN) de la Faculté de Droit, d'Economie et de Gestion de Valenciennes a organisé, le jeudi 18 mars 2010, une journée d'Etudes portant sur l'évaluation du dispositif juridique érigé en faveur des personnes handicapées. Il s'agissait d'établir un bilan provisoire de la mise en oeuvre de la loi numéro 2005-102 du 11 février 2005 pour l'égalité des chances, la participation et la citoyenneté des personnes handicapées. En effet, cette loi consacre un certain nombre de principes novateurs, tels que : l'inscription obligatoire de l'enfant handicapé dans son école de quartier ; l'obligation d'accessibilité des établissements recevant du public dans un délai de 10 ans ; l'obligation d'accessibilité des transports existants dans un délai de 10 ans, ou la mise en place de transports de substitution dans un délai de 3 ans. Il s'agissait également de rechercher ce qui fait obstacle à la mise en oeuvre effective des obligations légales, notamment en terme de technique juridique. La réflexion a donc été menée sur plusieurs fronts : une analyse d'ordre sémantique de la notion de handicap, une approche de politique législative en matière de handicap, une approche positiviste du contenu des droits des personnes handicapées, et une analyse normative des textes, à travers le prisme de la notion de discrimination.
