Aujourd'hui il y a plus de 200 accords commerciaux régionaux qui ont été notifié au GATT, puis à l’OMC. Les accords commerciaux régionaux les plus signalés sont des accords de libre-échange, c’est-à-dire les accords où les parties concernées éliminant entre eux les droits de douanes ainsi que les restrictions quantitatives à l'importation, mais conservant chacun leur propre politique commerciale vis à vis des pays tiers. Ces accords représentent 72 % de la totalité des accords signés. La quasi-totalité des membres de l'OMC sont parties à au moins un accord de libre-échange, et nombreux sont ceux qui participent à au moins deux accords de ce type. Ces accords caractérisent le régionalisme. Le multilatéralisme est le principe selon lequel des négociations, commerciales par exemple, doivent réunir tous les pays participant au commerce mondial pour en définir les règles. Ce principe est contenu dans L’Accord général sur les tarifs douaniers et le commerce qui fut signé en 1947. Ce traité régit le commerce mondial, dans la logique suivant la Seconde Guerre mondiale de fonder un nouvel ordre mondial sur un commerce pacifié. Ce multilatéralisme est accompagné dans les statuts du GATT de la clause de la nation la plus favorisée (article 1er de l’Accord général de 1947), c’est-à-dire que tout avantage commercial accordé à un pays doit également l’être à toutes les parties contractantes. L’OMC, qui remplace depuis 1995 le GATT, qui ne devait être que temporaire, poursuit les mêmes objectifs de libéralisation des échanges mondiaux, de défense d’une concurrence loyale, et de règlement des différends commerciaux par une institution au sein de l’OMC. Lors de la conférence de Doha s'est posée la question de savoir si les accords de libre-échange régionaux étaient en contradiction avec le système commercial multilatéral ou s'ils le soutenaient, c’est donc la question si les accords de libre-échange régionaux constituent une menace à l’OMC. En premier vue il semble que l’émergence du régionalisme pose une menace au multilatéralisme et donc à l’OMC elle-même (I). Cependant, le régionalisme n’est pas en mesure de pourvoir remplacer le multilatéralisme qui occupe une place importante dans le droit économique international (II).
