Book excerpt: Return to the nation's founding to rediscover the dramatic original debates--on presidential power, religious liberty, foreign corruption, and more--that still shape our world today When the Constitutional Convention adjourned on September 17, 1787, few Americans anticipated the document that emerged from its secret proceedings. James Madison, Alexander Hamilton, and the other framers had fashioned something radically new, a strong national government with broad powers. A fierce storm of argument soon broke out in advance of the state ratifying conventions that would decide the new plan's fate as Federalist supporters, Antifederalist opponents, and seekers of a middle ground praised, condemned, challenged, and analyzed the new Constitution. Here, in chronological order, are more than sixty newspaper articles, pamphlets, speeches, and private letters written or delivered during this ratification debate. Along with familiar figures such as Madison, Hamilton, and Patrick Henry, are dozens of lesser-known but equally engaged and passionate participants. The most famous writings of the period--especially the key Federalist essays--are placed in context alongside the arguments of insightful Antifederalists such as "Brutus" and the "Federal Farmer." Crucial issues quickly take center stage--the need for a Bill of Rights, the controversial compromises over slavery and the slave trade, whether religious tests should be imposed--and on questions that continue to engage and divide Americans: the relationship between the national government and the states, the dangers of unchecked presidential power and the remedy of impeachment, the proper role of the Supreme Court, fears of foreign and domestic corruption, and the persistent challenge of making representative government work in a large and diverse nation.

The debate climaxed in the arguments over the ratification of the Constitution. Through a selection of essential documents from 1787 and 1788, this new edition gives readers the flavor and immediacy of the great debate in all its fire, brilliance, and political intensity. Organized by topic, this is a convenient reference and teaching tool. This updated edition contains an entirely new section on the debate over class structure, property rights, and the economy under the proposed Constitution--an ideal introduction to a debate meaningful today.

The causes for the failure of the Constitution Amendment, 1987, known popularly as the Meech Lake Accord, are many and complex. This document looks at the period from the death of the Meech Lake Accord of 1987 to the 1992 referendum. It particularly examines the following points: approaches to constitutional reform, 1968-1987; the Meech Lake Accord, April 1987; approaches to constitutional reform, 1990-92; the Charlottetown Accord, August 1992; and the Canada and Quebec referendums, October 1992.

Book excerpt: In 2005 hopes for closer European integration were dealt a potentially fatal blow when French and Dutch voters rejected the proposed new European Union constitution. Going beyond the instant analysis of journalists, which placed blame for the failed vote on the two nations' internal politics, Democracy Needs Dispute examines a collection of media accounts of European policy debates to argue that the problem with the EU is its relative lack of vibrant political conflict. Democracy Needs Dispute offers both up-to-date analysis and a rich theoretical understanding of the problems facing further efforts at European integration.

Book excerpt: Behind the controversies that have marked the history of the idea of Economic Constitution emerges the highly political issue of the room for manoeuvre left to public authorities in the economic sphere. The notion thus encapsulates a fundamental tension: between democracy and rule of law, which model of legal ordering of the economy should prevail? From physiocrats to neo-liberals, from the Weimar Republic to European integration, from national constitutions to Global Governance, this collective book invites us to explore the genealogy of the controversial concept of Economic Constitution. The result of this interdisciplinary dialogue is a comprehensive reflection on the legal and political issues at stake in the current constitutionalization of the market order in Europe. Contributors are: Philippe Steiner, Guillaume Grégoire, Hugues Rabault, Peter C. Caldwell, Thomas Biebricher, Werner Bonefeld, Serge Audier, Vincent Valentin, Pieter van Cleynenbreugel, Xavier Miny, Frédéric Marty, Claire Mongouachon, Hans-Wolfgang Micklitz, Francesco Martucci, Michael Wilkinson, Hjalte Lokdam, Susanna Maria Cafaro, Peter Lindseth, Cristina Fasone, Pierre Nihoul, François Colly, Peter-Christian Müller-Graff, Tony Prosser, Damien Piron, Mahmoud Mohamed Salah, Stephen Gill, Thibault Biscahie, Sebastien Adalid, and Christian Joerges.

Book excerpt: This volume presents a wide selection of studies on the issues of law, land dispute and conflict (mediation) in Africa, reconsidering the role of state agents and other actors in these matters. The focus is on analyzing how citizens, state institutions and concerned (inter)national actors aim to find solutions to disputes, tension and conflict that are part of social life. The authors have approached the subject of Land, Law and Politics in Africa from a variety of disciplinary angles. The issues at stake comprise land access and land use, state politics and democratization efforts, the relationship between constitutional/state law and customary law, the challenges of urban and rural conflicts, border issues and the conceptions of (human) rights. On the basis of new empirical studies, the authors plead for a more holistic perspective on the above issues and on developmental policy in general. The book has 15 chapters in four thematic parts, focusing on historical and cultural aspects of politics and authority; land law and land disputes; constitutionalism and politics; and conflict studies. The volume is also a tribute to the work of Gerti Hesseling (1946-2009), a Dutch Africanist with a successful career as a scholar of constitutional and land law, focusing on West Africa.

Book excerpt: Originally published in 2005. Citizen involvement - and the concept of partnership - in urban governance has long been a major issue in the transformation of local democracy. The move from delegated to participative forms of local government has, in principle, profound consequences for governance at the scale of cities. However, it is clear that partnership and participation are interpreted in many different ways, according to the traditions of government in different countries. This volume brings together the experiences of three countries in which very different approaches to participation are evident: Canada, France and the United Kingdom. By comparing and reflecting on these countries' approaches and the resulting changes in governance, it provides an in-depth analysis of the intentions and effects of involving citizens in policy making. It also highlights innovative new forms of partnership which are emerging within metropolitan areas at a local level.

This book was released on 2018-05-25 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this ‘new order of the ages’ suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically ‘higher’ form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments – from the French Revolution to Napoleon’s downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first – Emmanuel Joseph Sieyès’ Du Jury Constitutionnaire (1795) – highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second – the 1812 draft of the Constitution of the Kingdom of Poland – presents the ‘constitutional propaganda’ of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe’s constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty.
