Il testo più noto è quello di Gaio, in ampia parte ripreso nelle Institutiones giustinianee. Il termine ‘istituzioni’ allude ai primi rudimenti e ad uno studio sistematico della materia a livello generale. Un carattere del diritto privato è di creare il corredo terminologico del giurista. Esso è il diritto più antico, quello più classico, da cui si sono formate le linee del diritto contemporaneo; fornisce termini, nozioni, definizioni, concetti, categorie che si trovano in tutti i sistemi giuridici e nelle altre branche del diritto. La base concettuale è tradizionalmente attinta dal diritto privato. Esso ha un’attitudine universale perché assolve ai bisogni della persona: potremmo dire che è il “cibo” della società. Il diritto non è una scienza dell’essere, ma del dover essere: è una scienza assiologica. Esso, a differenza di molte scienze naturali, si esprime attraverso parole proprie del linguaggio corrente. Ciò, per un verso, è una facilitazione perché lo rende rapidamente intellegibile; per altro verso, una ragione di difficoltà perché le medesime parole, nel linguaggio giuridico, possono avere un significato diverso da quello che assumono nel linguaggio corrente [ad es. la parola ripetere, che nel linguaggio comune ha il significato di fare nuovamente, nel lessico giuridico ha il significato latino di recuperare; la parola tradizione, che nel linguaggio corrente ha il senso della trasmissione di un uso, nel significato giuridico si riferisce alla consegna della cosa, dal latino tradere]. La realtà giuridica è fatta di parole perché esprime i fatti e li qualifica nella dimensione giuridica: il linguaggio, dunque, non può essere approssimativo.
