Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the way in which legal historians and legal scientists used the past to legitimize, challenge, explain and familiarize the socialist legal orders, which were backed by dictatorial governments. The volume studies legal historians and legal histories written in Eastern European countries during the socialist era after the Second World War. The book investigates whether there was a unified form of socialist legal historiography, and if so, what can be said of its common features. The individual chapters of this volume concentrate on the regimes that situate between the Russian, and later Soviet, legal culture and the area covered by the German Civil Code. Hence, the geographical focus of the book is on East Germany, Russia, the Baltic states, Poland and Hungary. The approach is transnational, focusing on the interaction and intertwinement of the then hegemonic communist ideology and the ideas of law and justice, as they appeared in the writings of legal historians of the socialist legal orders. Such an angle enables concentration on the dynamics between politics and law as well as identities and legal history. Studying the socialist interpretations of legal history reveals the ways in which the 20th century legal scholars, situated between legal renewal and political guidance gave legitimacy to, struggled to come to terms with, and sketched the future of the socialist legal orders. The book will be a valuable resource for academics and researchers working in the areas of Legal History, Jurisprudence and Philosophy of Law and European Studies. Available in PDF, EPUB and Kindle. Book excerpt: Momentous events of recent years have shown the tremendous potential for developing and applying international law, even in the area that has always presented the greatest challenge to the rule of law—the use of force. The collaborative response by the United States, the Soviet Union, and other major powers to the Iraqi army's invasion and occupation of Kuwait showed unprecedented unity on the relevance of international law, its rules, and its enforceability through decisions of the UN Security Council. What explains this historic convergence of views? What differences remain about the legality of using armed force in the new international order that is emerging with the end of the Cold War? Law and Force in the New International Order offers a timely and comprehensive inquiry into the growing number of situations where the temptation or necessity to use military force confronts the tenets of international law. Distinguished American and Soviet legal scholars and practitioners explore the idea of the primacy of law over politics, the notion held by some that U.S. military force may be applied for the sake of democracy at a time when Moscow has rejected the Brezhnev Doctrine, the tension between collective security and collective self-defense during the Iraq-Kuwait crisis, and the prospects for the use of force being authorized by the United Nations and regional organizations. The contributors also examine the vexing legal issues raised by interventions to protect human rights, to overthrow "illegitimate" regimes, and to combat international terrorism and drug trafficking; the restraints on the use of force promised by new arms control agreements; and the future role of the World Court and other tribunals in preventing or settling disputes involving the threat or use of force.

Book excerpt: This edited volume explores ideas of legal realism which emerge through the works of Russian legal philosophers. Apart from the well-known American and Scandinavian versions of legal realism, there also exists a Russian one: readers will discover fresh perspectives and that the collection of early twentieth century ideas on law discussed in Russia can be understood as a unified school of legal thought – as Russian legal realism. These chapters by renowned European and Eastern European legal philosophers add to ongoing discussions about the nature of law, especially in the context of developments around our scientific knowledge about the mind and behaviour. Analyses of legal phenomena carried out by legal realists in Russia offer novel arguments in favour of embracing psychological and sociological perspectives on the law. The book includes analysis of the St. Petersburg school of legal philosophy and Leon Petrażycki’s psychological theory of law. This original and multifaceted research on Russian realists is of considerable value to an international audience. Researchers and postgraduate students of law, legal theory and legal ethics will find the book particularly appealing, but it will also interest those investigating the philosophy or sociology of law, or legal history.

Available in PDF, EPUB and Kindle. Book excerpt: When the first edition of Professor Butler's book was published in 1999 it was hailed as the first systematic account of Russian law and the Russian legal system since the demise of the Soviet Union. In this new edition the author builds on his examination of Russian law in the context of other legal systems and makes a thorough examination of the country's legal institutions and prodecural and substantive law. The book has been updated throughout to include the latest codifications on criminal and administrative procedure, tax, labour, land, the environment, civil law, and company law. Butler's emphasis is on post-Soviet law reform and on the creation of a democratic, market-oriented legal framework which seeks to attract foreign investment. Chapters such as those on entreprenurial law, securities regulation, banking and insurance, taxation, and the status of foreigners and foreign investment law make this volume an essential purchase for those advising potential investors in Russia and the CIS. For those with a more academic interest in Russian law there are also chapters on Russian legal history and legal theory, together with a detailed guide to relevant publications and materials. This authoritative work will be embraced by practising lawyers, the investment community, government legal advisers and scholars seeking a comprehensive and practical introduction to the Russian legal system.

Book excerpt: This study traces the development of the Soviet Bar through periods of legal nihilism and legal revival to its final integration into the Soviet order at the end of the 1930s--a story of uncertainty and conflict in the Bolshevik ranks over the role of the lawyer under socialism and one of resistance to Soviet power by a profession jealous of its own autonomy Originally published in 1986.
