Book excerpt: This study was designed to examine different Kentucky law enforcement agencies' policies and practices regarding the police use of force. It will show the similarities and differences between police departments, and how departmental size, structure, and other characteristics for the department and of the police officers employed at these departments influences the policies and practices a department might have. This is an important topic to study since it is common for smaller police departments to not have up-to-date departmental policies governing the use of force that is common in larger police departments. And since in light of past and recent history when it comes to litigation involving the use of force of police departments of all sizes, it is necessary to evaluate their policies and the effectiveness of them. This research will answer the question: does the size and other characteristics of a police department influence the quality of their use of force policy? To answer this question, a survey was mailed out to law enforcement agencies in Kentucky and a content analysis was performed. The remainder of this thesis will discuss the method used for this research analysis, describe the survey used for the sample selected, talk about the limitations of the study, as well as discuss the findings and results of the study. Finally, this study will conclude with thoughts and suggestions involving future insight into this topic area.

Do we want a justice system that can convict an innocent person based solely on a "gotcha" statute? I hope this understanding of what can happen to innocent, though uninformed, individuals will result in a knowledge that prevents this from happening to future covered professionals on federal lands and hopefully causes a reexamination of our elements of justice and the elimination of this terrible outcome.
