Book excerpt: In spite of its privileged place on the African continent, in the Muslim world and in the Middle East and North Africa region, Algeria remains poorly known, and the works relating to contemporary Algerian society published outside of Algeria are rare. This book seeks to contribute to our understanding of Algerian society today, through its relationships to property and to law. Beyond this, the objective is to propose, in a comparative perspective proper to anthropology, new theoretical and methodological perspectives by which to apprehend the anthropology of law in a Muslim context. Algeria, as a post-colonial and post-Socialist State, whose population is overwhelmingly Muslim, proves to be a particularly interesting case to study. Contributors are: Hichem Amichi, Emilie Barraud, Ammar Belhimer, Yazid Ben Hounet, Nejm Benessaiah, Sami Bouarfa, Tarik Dahou, Baudouin Dupret, Marcel Kuper, Judith Scheele, Alice Wilson.

This book was released on 2019-12-15 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a masterful study of the ways in which sex and law were inextricably intertwined in the elaboration of French rule in Algeria. Its great virtue is to demonstrate in careful detail, with an impressive range of material (from court records to novels), exactly how the conquest of Algeria repeatedly challenged the very ideals of the secular universalism in whose name colonization was carried out.― Joan Wallach Scott, author of Sex and Secularism During more than a century of colonial rule over Algeria, the French state shaped and reshaped the meaning and practice of Muslim law by regulating it and circumscribing it to the domain of family law, while applying the French Civil Code to appropriate the property of Algerians. In Sex, Law, and Sovereignty in French Algeria, 1830–1930, Judith Surkis traces how colonial authorities constructed Muslim legal difference and used it to deny Algerian Muslims full citizenship. In disconnecting Muslim law from property rights, French officials increasingly attached it to the bodies, beliefs, and personhood. Surkis argues that powerful affective attachments to the intimate life of the family and fantasies about Algerian women and the sexual prerogatives of Muslim men, supposedly codified in the practices of polygamy and child marriage, shaped French theories and regulatory practices of Muslim law in fundamental and lasting ways. Women's legal status in particular came to represent the dense relationship between sex and sovereignty in the colony. This book also highlights the ways in which Algerians interacted with and responded to colonial law. Ultimately, this sweeping legal genealogy of French Algeria elucidates how "the Muslim question" in France became—and remains—a question of sex.

Available in PDF, EPUB and Kindle. Book excerpt: Covering a period of five hundred years, from the arrival of the Ottomans to the aftermath of the Arab uprisings, James McDougall presents an expansive new account of the modern history of Africa's largest country. Drawing on substantial new scholarship and over a decade of research, McDougall places Algerian society at the centre of the story, tracing the continuities and the resilience of Algeria's people and their cultures through the dramatic changes and crises that have marked the country. Whether examining the emergence of the Ottoman viceroyalty in the early modern Mediterranean, the 130 years of French colonial rule and the revolutionary war of independence, the Third World nation-building of the 1960s and 1970s, or the terrible violence of the 1990s, this book will appeal to a wide variety of readers in African and Middle Eastern history and politics, as well as those concerned with the wider affairs of the Mediterranean.

Book excerpt: In this book, Omer Awass examines the formation, history, and transformation of the Islamic legal discourse and institutions through the lens of a particular legal practice: the issuance of fatwas (legal opinions). Tracing the growth of Islamic law over a vast geographical expanse -from Andalusia to India - and a long temporal span - from the 7th to the 21st century, he conceptualizes fatwas as the 'atomic units' of Islamic law. Awass argues that they have been a crucial element in the establishment of an Islamic legal tradition. He also provides numerous case studies that touch on economic, social, political, and religious topics. Written in an accessible style, this volume is the first to offer a comprehensive investigation of fatwas within such a broad spatio-temporal scope. It demonstrates how instrumental fatwas have been to the formation of Islamic legal traditions and institutions, as well as their unique forms of reasoning.

Available in PDF, EPUB and Kindle. Book excerpt: This book brings together contributors across the disciplines to examine the local, national, regional and global processes that have shaped Maghribi societies, economies and politics since the colonial period. Focusing equally on the local shape of global processes and on the broader significance of particular ‘ways of doing things’, these studies move beyond generalisations about globalisation and its impact on local societies, whether developmental or detrimental, of the ‘global in the local’, or of ‘glocalisation’. Cases range from the onset of the ‘first wave’ of globalisation in the colonial era to the most recent developments in identity politics, consumerism, and telecommunications. Contributors show how nationalising and globalising influences are seized, remade, and put to work in very different ways by High Atlas farmers or urban real estate speculators, human rights activists at the edge of the Sahara and amateur theatre actors in Mediterranean towns. Always located somewhere, these social actors nonetheless act in different ways, with different effects, at different levels of engagement, whether with each other, their own governments, or the wider world. This book was published as a special issue of the Journal of North African Studies.
