Price, author of The Modern Fac tory. Through the institutions created by the Protocol, the industry was lifted to a higher plane of sanitary and health protection regulation, with marked material ad vances to the workers. Although the Protocol was terminated in May, 1915, a few months later, through the conciliatory efforts of the Mayor's Council of Con ciliation, consisting of Dr. Felix Adler, the leader of the Society for Ethical Culture, Walter C. Available in PDF, EPUB and Kindle. Book excerpt: A historian traces the origins of the modern law-and-order state to a surprising source: the liberal policies of the New Deal. Most Americans remember the New Deal as the crucible of modern liberalism. But while it is most closely associated with Roosevelt’s efforts to end the Depression and provide social security for the elderly, we have failed to acknowledge one of its most enduring legacies: its war on crime. Crime policy, Anthony Gregory argues, was a defining feature of the New Deal. Tough-on-crime policies provided both the philosophical underpinnings and the institutional legitimacy necessary to remake the American state. New Deal Law and Order follows President Franklin Roosevelt, Attorney General Homer Cummings, and their war on crime coalition, which overcame the institutional and political challenges to the legitimacy of national law enforcement. Promises of law and order helped to manage tensions among key Democratic Party factions—organized labor, Black Americans, and white Southerners. Their anticrime program, featuring a strengthened criminal code, an empowered FBI, and the first federal war on marijuana, was essential to the expansion of national authority previously stymied on constitutional grounds. This nascent carceral liberalism both accommodated a redoubled emphasis on rehabilitation and underwrote a massive wave of prison construction across the country. Alcatraz, an unforgiving punitive model, was designed to be a “symbol of the triumph of law and order.” This emergent security state eventually transformed both liberalism and federalism, and in the process reoriented the terms of US political debate for decades to come.

Available in PDF, EPUB and Kindle. Book excerpt: Twenty-five years after independence, Papua New Guinea is beset by social, economic, and political problems: poverty and inequality, a young and expanding population, a stagnant economy, corruption, and rising crime. The state has not only failed to contain these problems but has become progressively implicated in their persistence. Escalating levels of violence and lawlessness are seen by many as the most serious challenge facing the young country. This book examines these problems of order in light of Papua New Guinea’s remarkable social diversity and the impact of rapid and pervasive processes of change. Three original and strategic case studies involving urban gangs, mining security, and election violence form the core of the work. Each case study looks at particular forms of conflict, and the responses these engender, across different socioeconomic contexts and geographic locations. Empirical data are analyzed through a common framework that employs material, cultural and institutional perspectives, allowing readers to view the three cases through different theoretical prisms, identify linkages between them, and, in the process, build a larger picture of the post-colonial social order. Law and Order in a Weak State charts not only the problems of crime and lawlessness in Papua New Guinea but also the possibilities for constructive, pragmatic solutions. It will be of great interest to scholars, aid and policy officials, and others concerned with understanding the social complexities and challenges of contemporary Papua New Guinea.

Book excerpt: The oil and gas industry’s wide international exposure and constantly changing landscape leave it particularly vulnerable to disputes. As this practical book demonstrates, the risks associated with disputes can be mitigated by parties utilising governing law and dispute resolution clauses in contractual agreements within the sector. Examining a global range of jurisdictions, the book offers clear guidance on the most appropriate choice of law and choice of dispute resolution forum for oil and gas contracts, analysing the key issues and defining the legal contours involved.

Book excerpt: This book offers a critical and timely account of how labour law has become a means for protecting employers rather than workers. The past few decades have witnessed something of a ‘silent revolution’ in the traditional protective role that labour law has played in the lives of workers. While this transformation has been overt in the realm of the market and at the level of the legislature, the role of the judiciary in this process remains significantly under-studied. Focussing on Australia, but drawing also on material from New Zealand, the UK and Canada, this book investigates how the common law has intervened to shape labour law in the image of commercial contract, determining disputes and defining legal issues by ignoring the realities of working life. Under this new conception of labour law, industrial relations between workers and employers are rarely reciprocal or relational. Rather, they are determined by the legal meaning and purpose of the contract of employment, drafted by lawyers for the benefit of employers and their human resources departments. Having demonstrated how approaches to contractual formalist legal reasoning have redefined labour law, this book goes on to propose an array of innovative legal and policy strategies to restore the protective role of labour law to the employment relationship. Scholarly, but also accessible to students, this book will appeal to those with interests in labour law, contract law and sociolegal studies.
