Ce volume, intitulé L'autorité de l'écrit au Moyen Age, traite tout à la fois de la production de l'écrit, de l'autorité du document et de la constitution d'archives dans l'Occident médiéval comme dans les mondes byzantin et musulman. Il envisage en premier lieu la place de l'écrit dans les sociétés où la parole et le geste sont essentiels, considérant les groupes qui ont pour métier d'écrire (rédacteurs, clercs de chancellerie, cadis ...), étudiant leurs pratiques et la diffusion des techniques d'écritures mises en œuvre. L'usage de l'écrit conduit à la question de l'autorité du document produit et de son efficacité : l'écrit et les gestes enregistrés, les signes de validation, la qualité des personnes qui le présentent et celle des témoins qui le souscrivent, les choix linguistiques multiples adoptés par les rédacteurs, les situations dans lesquelles le document a été utilisé, même pour le falsifier. Dans le monde musulman par exemple, où la fiabilité de témoins intègres est supérieure à celle d'un document écrit, potentiellement falsifiable, on comprend que le statut du document écrit, son aptitude à faire preuve, soit moindre qu'en Occident où c'est une de ses premières fonctions. La constitution et la conservation d'archives sont au cœur des enjeux de pouvoir : à qui est confiée la garde des documents et dans quels lieux ? Ici aussi Occident et Orient se distinguent par leurs pratiques : les rois de France pensaient que la constitution des registres d'actes royaux manifestait leur pouvoir alors que les souverains musulmans ne voyaient pas dans la conservation systématique de leurs archives, pourtant élaborées de façon sophistiquée, un signe éminent de souveraineté. Ont enfin été abordées les questions des conservations aléatoires, des abandons, des destructions, des copies, des traductions et des faux, ouvrant ainsi de nouvelles pistes de recherche.

Book excerpt: “How could I allow my soldiers to sail on this disloyal and cruel sea?” These words, attributed to the most powerful caliph of medieval Islam, Umar Ibn al-Khattab (634–644), have led to a misunderstanding in the West about the importance of the Mediterranean to early Islam. This body of water, known in Late Antiquity as the Sea of the Romans, was critical to establishing the kingdom of the caliphs and for introducing the new religion to Europe and Africa. Over time, it also became a pathway to commercial and political dominion, indispensable to the prosperity and influence of the Islamic world. Sea of the Caliphs returns Muslim sailors to their place of prominence in the history of the Islamic caliphate. As early as the seventh century, Muslim sailors competed with Greek and Latin seamen for control of this far-flung route of passage. Christophe Picard recreates these adventures as they were communicated to admiring Muslims by their rulers. After the Arab conquest of southern Europe and North Africa, Muslims began to speak of the Mediterranean in their strategic visions, business practices, and notions of nature and the state. Jurists and ideologues conceived of the sea as a conduit for jihad, even as Muslims’ maritime trade with Latin, Byzantine, and Berber societies increased. In the thirteenth century, Christian powers took over Mediterranean trade routes, but by that time a Muslim identity that operated both within and in opposition to Europe had been shaped by encounters across the sea of the caliphs.

Much of our understanding of governmental practices and expressions of authority come from the contents of such documents, which have been well studied. Less studied, however, are the records themselves as artefacts. This volume is an attempt to redress this balance by taking a more holistic, material approach to a range of written records. Through a series of case studies, this volume explores questions regarding the material characteristics of various records and their use. It demonstrates that the material features of the records, including the size and shape, the hands that wrote them and the material substrate, can shed new light on the functioning of government and the declarations of power these records asserted. The ten contributions of this volume focus on records from a variety of rulers, political systems and administrations. With four case studies from early China and six from medieval Europe, this volume offers transcultural perspectives to demonstrate how different cultures expressed rulership and administration materially through the use of text-bearing artefacts.

Book excerpt: This volume is concerned with diplomacy between England and the papal curia during the first phase of the Anglo-French conflict known as the Hundred Years' War (1305-1360). On the one hand, Barbara Bombi compares how the practice of diplomacy, conducted through both official and unofficial diplomatic communications, developed in England and at the papal curia alongside the formation of bureaucratic systems. On the other hand, she questions how the Anglo-French conflict and political change during the reigns of Edward II and Edward III impacted on the growth of diplomatic services both in England and the papal curia. Through the careful examination of archival and manuscript sources preserved in English, French, and Italian archives, this book argues that the practice of diplomacy in fourteenth-century Europe nurtured the formation of a "shared language of diplomacy". The latter emerged from the need to "translate" different traditions thanks to the adaptation of house-styles, formularies, and ceremonial practices as well as through the contribution of intermediaries and diplomatic agents acquainted with different diplomatic and legal traditions. This argument is mostly demonstrated in the second part of the book, where the author examines four relevant case studies: the papacy's move to France after the election of Pope Clement V (1305) and the succession of Edward II to the English throne (1307); Anglo-papal relations between the war of St Sardos (1324) and the deposition of Edward II in 1327; the outbreak of the Hundred Years' Wars in 1337; and lastly the conclusion of the first phase of the war, which was marked in 1360 by the agreement between England and France known as the Treaty of Bretigny-Calais.

Book excerpt: Modern historiography has become accustomed to portraying the emperor Theophilos of Byzantium (829-842) in a favourable light, taking at face value the legendary account that makes of him a righteous and learned ruler, and excusing as ill fortune his apparent military failures against the Muslims. The present book considers events of the period that are crucial to our understanding of the reign and argues for a more balanced assessment of it. The focus lies on the impact of Oriental politics on the reign of Theophilos, the last iconoclast emperor. After introductory chapters, setting out the context in which he came to power, separate sections are devoted to the influence of Armenians at the court, the enrolment of Persian rebels against the caliphate in the Byzantine army, the continuous warfare with the Arabs and the cultural exchange with Baghdad, the Khazar problem, and the attitude of the Christian Melkites towards the iconoclast emperor. The final chapter reassesses the image of the emperor as a good ruler, building on the conclusions of the previous sections. The book reinterprets major events of the period and their chronology, and sets in a new light the role played by figures like Thomas the Slav, Manuel the Armenian or the Persian Theophobos, whose identity is established from a better understanding of the sources.

It introduces the model that evolved during the 7th to the 9th centuries, which involved four judicial institutions: the cadi, the court of complaint (mazalim), the police/shurta (responsible for criminal justice) and the Islamized market law (hisba) administrated by the market supervisor/muhtasib. Literary and non-literary sources are used to highlight how these institutions worked in real-time situations such as the famine of 1024-1025, which posed tremendous challenges to the market supervisors in Cairo. The inner workings of the court of complaint during the 11th-12th century Fatimid state are revealed through array of documentary sources. Further, non-Muslim communities, their courts and their sphere of responsibilities are treated as integral to how justice was dispensed in medieval Islam. Documentary sources offers significant insights into these issues and illuminate the scope and limits of non-Muslims self-rule/judicial autonomy.In sum, the book shows that the administrative and political history of the judiciary in medieval Egypt implicitly and explicitly illuminates broader questions about religious and social forces that shaped the lives of medieval people in the Middle East, Muslims and non-Muslims alike.
