Book Synopsis Law and Opinion in Scotland during the Seventeenth Century by : John D Ford
Download or read book Law and Opinion in Scotland during the Seventeenth Century written by John D Ford and published by Bloomsbury Publishing. This book was released on 2007-11-20 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Britain at least, changes in the law are expected to be made by the enactment of statutes or the decision of cases by senior judges. Lawyers express opinions about the law but do not expect their opinions to form part of the law. It was not always so. This book explores the relationship between the opinions expressed by lawyers and the development of the law of Scotland in the century preceding the parliamentary union with England in 1707, when it was decided that the private law of Scotland was sufficiently distinctive and coherent to be worthy of preservation. Credit for this surprising decision, which has resulted in the survival of two separate legal systems in Britain, has often been given to the first Viscount Stair, whose Institutions of the Law of Scotland had appeared in a revised edition in 1693. The present book places Stair's treatise in historical context and asks whether it could have been his intention in writing to express the type of authoritative opinions that could have been used to consolidate the emerging law, and whether he could have been motivated in writing by a desire to clarify the relationship between the laws of Scotland and England. In doing so the book provides a fresh account of the literature and practice of Scots law in its formative period and at the same time sheds light on the background to the 1707 union. It will be of interest to legal historians and Scots lawyers, but it should also be accessible to lay readers who wish to know more about the law and legal history of Scotland
Book Synopsis Histoire du droit savant (13e–18e siècle) by : Robert Feenstra
Download or read book Histoire du droit savant (13e–18e siècle) written by Robert Feenstra and published by Taylor & Francis. This book was released on 2023-07-14 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: This third selection of articles by Robert Feenstra complements the two previously published, continuing his studies of doctrines of private law and of texts related to university teaching from the 13th century into the early modern period. In the section on private law, some pieces deal with the Middle Ages, while others focus on Hugo Grotius. Property is again an important topic, but this time joined by legal personality (foundations) and negligence (vicarious liability included). The studies on the history of texts are mainly concerned with works dating from the 14th and 15th centuries. One is devoted to a little-known civil law teacher at the University of Orléans and his commentary on a part of the Digest. The four others deal with treatises belonging to the so-called 'vulgarisation' of the 'droit savant' (medieval Roman and Canon law); most of these include important contributions to the history of early printing (incunabula and post-incunabula).

Spanish legal culture, developed during the Spanish Golden Age, has had a significant influence on the legal norms and institutions that emerged in Europe and in Latin America. Each chapter discusses a jurist within his or her intellectual and political context. All chapters have been written by distinguished legal scholars from Spain and around the world. Book excerpt: Much attention is paid nowadays to the remarkable increase in the speed of communication that is transforming our planet into a global village. In fact, international contacts across frontiers have been with us for centuries.Humans were wandering nomads before becoming traveling salespeople who built towns and countries. They were naturally interested in what was going on next door. The European invention of the printed book and the appearance of printers and publishers made an important contribution to the scientific, cultural and intellectual development of the continent. The Low Countries, in particular Flanders with Dirk Martens and Christoffel Plantin Moretus, played a key role in this revolution, the value of which we still recognise today. This important event was the subject of a colloquium organised on 9 June 2000 by the Centre for European Culture under the auspices of the Royal Flemish Academy of Belgium for Science and the Arts.
