La orientación sexual y la identidad de género se reconocen cada vez más como motivos de discriminación en la legislación europea y nacional. En 2010, la Comisión Europea le pidió a la FRA que recabara datos comparables sobre la discriminación y los delitos motivados por prejuicios de los que son víctimas las personas LGBT en todos los Estados miembros de la UE y Croacia. Atendiendo tal petición, la FRA puso en marcha en 2012 su encuesta en línea sobre las experiencias de las personas LGBT en la UE, la cual recibió 93 079 respuestas. La encuesta proporcionó un elevado volumen de datos comparables que han permitido a la FRA formular sus conclusiones y recomendaciones basadas en datos empíricos. Esa aportación puede ayudar a las instituciones y los Estados miembros de la UE a identifi car y abordar los problemas que afrontan las personas en lo que se refi ere a sus derechos fundamentales, sirviéndose al efecto de respuestas jurídicas y políticas orientadas que garanticen la protección y la observancia de tales derechos.

Book excerpt: La presente investigación surge de la necesidad de conocer cómo las personas cuya orientación sexual e identidad de género son distintas a la norma cisgénero y heterosexual viven su ciudadanía en Lima Metropolitana. Para poder aproximarnos a la comprensión de esta realidad es importante tener en cuenta algunos elementos que introduciremos a continuación y que estarán presentes a lo largo de este documento. En primer lugar, es importante entender que la construcción histórica del proyecto de Estado-Nación peruano ha tomado en cuenta la garantía de derechos para un sujeto de derecho hegemónico: hombre, blanco, con patrimonio, profesional, cisgénero, heterosexual, casado y católico. Las leyes en nuestro país no han sido pensadas para garantizar derechos a mujeres, personas que no hablan castellano o no forman parte de la cultura occidental, grupos indígenas, afrodescendientes, personas con discapacidades, sectores periféricos, grupos con bajos recursos y sin propiedades a su nombre, y tampoco fueron pensadas para el colectivo LGBTIQ; menos aún se ha pensado en la garantía de derechos a personas en las que concurren todas estas identidades al mismo tiempo. En toda sociedad humana los recursos son limitados, por lo que se establecen formas de redistribución de los mismos bajo principios que ordenan la vida en sociedad. La redistribución de recursos responde a las relaciones de poder que establecen los individuos de dicha sociedad, relaciones que en los países que han sufrido procesos de colonización, como el nuestro, responden a los procesos de diferenciación que han marcado la historia de desigualdad y conlicto que atraviesa nuestro país. Han sido muy pocos los libros de historia oicial y los pensadores que desde la academia han evidenciado cómo las variables de sexualidad y de género constituyen también la construcción de nuestra Nación, pues suele presentarse la historia como marcada por hechos realizados por hombres, entre leyes y guerras, lo cual invisibiliza cómo la posibilidad de acceder a estos recursos está marcada por la desigualdad basada en el género. Bajo la misma lógica, la historia oicial no ha documentado la existencia de personas que diieren de la norma heterosexual, pues es justamente sobre la construcción de la heterosexualidad como norma que se justiica la manutención del poder en manos de sujetos hegemónicos. La hegemonía cisheteronormativa, entonces, es el sistema político y cultural por el cual los sujetos dominantes sustentan su poder (fundamentado en el sistema racista, clasista, machista y homofóbico), mediante la reproducción de sus valores, creencias y objetivos como intereses universales, lo cual naturaliza la desigualdad y la presenta como normal, y permite mantener al resto de individuos dominados bajo el orden social que plantean. En el caso de nuestra ciudad, la construcción de una norma de ciudadanos cisgénero y heterosexuales se ha implementado mediante instituciones como la Iglesia, el sistema médico, las leyes, los medios de comunicación, las prisiones y las escuelas, mediante el constante refuerzo de que la única forma aceptable de existir en el mundo es ser heterosexual y respetar los roles asignados según el género: las mujeres deben ser madres abnegadas y los hombres machos proveedores. Cumplir con esos roles es la única forma de acceder a recursos y garantizar la propia supervivencia, tener una efectiva participación política (por eso tenemos funcionarios públicos LGBTIQ contados con los dedos de la mano), acceder plenamente al derecho a la educación en un espacio seguro, verse representado de forma positiva en los medios de comunicación, acceder a un trabajo digno y a un documento de identidad que te represente, y formar una familia al igual que el resto de ciudadanos y ciudadanas.

Using theories and ideas drawn from psychology, sociology, anthropology, and ethology, this book aims to conceptualize homophobic bullying as a construct of dominant institutions and groups that reinforce beliefs about the abnormality of homosexuality. Rivers demonstrates how bullying is a complex social process in which perpetrators are supported by active confederates, passive bystanders, and indifferent onlookers. Rivers also discusses new forms of bullying, such as cyberbullying, and explores the theoretical and social-psychological implications of bullying using new technologies. He discusses the challenges faced by teachers in eroding negative, implicit attitudes in the face of socially acceptable, explicit expressions of these attitudes. Included here are primary data drawn from various studies that Rivers has conducted over the past two decades, along with discussions of key studies conducted by other researchers in the US, Canada, UK, Australia, and Scandinavia. Rivers explores the psycho-social correlates and potential long-term effects of bullying and homophobia, using various clinical studies as a guide to understanding the potential harm that results from school-based aggression. This discrimination and violence lead to exclusion, which adversely impacts their lives, as well as the communities and economies in which they live. A major barrier to addressing this stigma and sexual orientation and gender identity(SOGI)-based exclusion is the lack of SOGI-specific data. Robust, quantitative data on di‚fferential development experiences and outcomes of sexual and gender minorities--especially those in developing countries--is extremely thin. This paucity of data jeopardizes the achievement of the Sustainable Development Goals and countries' commitment to the principle of 'leaving no one behind' in the eff‚ort to end poverty and inequality. 'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. This report cov‚ers numerous policy recommendations to prevent and eliminate discriminatory practices in all of the areas covered. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. It will seek to deepen knowledge, facilitate peer learning of good practices, and encourage reforms to increase the inclusion of sexual and gender minorities.

Anti-homosexual violence also reinforces the creation of consensus around these projects of change. Resistance to that violence are reason to mobilize and become political actors.
