Book excerpt: "This book reviews the common law principles that underpin modern land use regulations, including covenants and restrictions that work with government regulation to limit the use of private property. The Nutshell clearly explains the legal aspects of land planning and regulation, project review processes, and innovative and flexible regulatory devices. Subdivision and site plan regulation, local environment law, discrimination in zoning based on race and religion, regulatory takings, inverse condemnation, and community development practices are all explored. In addition, the book discusses the law of smart growth, and addresses current trends in land use law including the siting of renewable energy facilities, marijuana and drones. An appendix of internet-based resources is also provided. Law and planning students will find that this Nutshell covers the key cases in all land use law textbooks, and seasoned practitioners and planners will find the organization and approach to dozens of subject areas beneficial to their understanding of the nuts and bolts of land use law as well as some current trends."--Publisher.

Available in PDF, EPUB and Kindle. Book excerpt: Land Use Law in Florida presents an in-depth analysis of land use law common to many states across the United States, using Florida cases and statutes as examples. Florida case law is an important course of study for planners, as the state has its own legal framework that governs how people may use land, with regulation that has evolved to include state-directed urban and regional planning. The book addresses issues in a case format, including planning, land development regulation, property rights, real estate development and land use, transportation, and environmental regulation. Each chapter summarizes the rules that a reader should draw from the cases, making it useful as a reference for practicing professionals and as a teaching tool for planning students who do not have experience in reading law. This text is invaluable for attorneys; professional planners; environmental, property rights, and neighborhood activists; and local government employees who need to understand the rules that govern how property owners may use land in Florida and around the country.

Book excerpt: City Rules offers a challenge to students and professionals in urban planning, design, and policy to change the rules of city-building, using regulations to reinvigorate, rather than stifle, our communities. Emily Talen demonstrates that regulations are a primary detriment to the creation of a desirable urban form. While many contemporary codes encourage sprawl and even urban blight, that hasn't always been the case-and it shouldn't be in the future. Talen provides a visually rich history, showing how certain eras used rules to produce beautiful, walkable, and sustainable communities, while others created just the opposite. She makes complex regulations understandable, demystifying city rules like zoning and illustrating how written codes translate into real-world consequences. Most importantly, Talen proposes changes to these rules that will actually enhance communities' freedom to develop unique spaces.

Available in PDF, EPUB and Kindle. Book excerpt: Common Property Economics defines and clarifies the theoretical distinction between open access and common property and empirically tests the adequacy of resource allocation under common property in comparison with private property. The book presents theoretical models to demonstrate overexploitation under open access. Seven necessary and sufficient conditions differentiate common property from open access. Swiss alpine grazing commons are contrasted with grazing in the English open field system. Statistical work using Swiss data compares the performance of common property with private property. Whether it be fisheries, grazing land, oil and gas pools, groundwater, or wildlife, group use of natural resources has long received the blame for overexploitation and mismanagement. In this book two types of group use are identified: open access and common property. Open access refers to resource utilization without any controls on extraction rates, a situation in which resource overexploitation often occurs. On the other hand, "common property" is a term that ought to be reserved for group use in which outside access and user extraction rates are controlled.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive survey of the major legal issues that arise in the course of a construction project. The structure of the book first focuses on the major participants on a project and the relationships and interests of each of participant. It then shifts to chapters on recurring themes in construction law such as the economic loss rule, calculation of damages, and defective construction. While making the concepts accessible for any reader, the book provides a logical structure for those teaching construction law to use as either the primary or supplemental reading for the course. The second edition, in addition to adding new substantive material and case examples, is also updated to reference the 2017 revisions to the AIA construction documents.
