Book excerpt: There are certain inherent problems with land because of its peculiar characteristics, which impede the natural emergence of a well-functioning market. The legal and regulatory framework can potentially overcome these problems. In India, despite some reform efforts, the land market continues to be highly distorted and inefficient. Land records are inaccurate, outdated, and incomprehensive. There are widespread uncertainties relating to land titles, which have hurt the market. Transaction costs are significantly high by international standards, which have discouraged formal land transactions. Initiatives which could have made the market function better have not been taken; while some regulations have been introduced which have introduced or magnified the distortions in the market. A major negative consequence of this underdeveloped and distorted market is that promoters of industrial and infrastructure projects have eschewed market negotiations for land acquisition and have favored the use of eminent domain powers. While reforms have begun in many areas, an area that has been left untouched relates to regulatory restraints on land use. The most notable has been the requirement of NAC. Because the clearance is typically given after land is transferred from one party to another, there is a significant transfer of wealth from farmers to project proponents, which has been the source of a great deal of social discontent. The elimination of this restriction on land use would go a long way towards making the land market a great deal more efficient than it is now.

Book excerpt: Abstract: May 1999 - Access to land is deeply important in rural India, where the incidence of poverty is highly correlated with lack of access to land. The author provides a framework for assessing alternative approaches to improving access to land by India's rural poor. He considers India's record implementing land reform and identifies an approach that includes incremental reforms in public land administration to reduce transaction costs in land markets (thereby facilitating land transfers) and to increase transparency, making information accessible to the public to ensure that socially excluded groups benefit. Reducing constraints on access to land for the rural poor and socially excluded requires five key issues: restrictions on land-lease markets, the fragmentation of holdings, the widespread failure to translate women's legal rights into practice, poor access to (and encroachment on) the commons, and high transaction costs for land transfers. Among guidelines for policy reform the author suggests: Selectively deregulate land-lease (rental) markets, because rental markets may be important in giving the poor access to land; Reduce transaction costs in land markets, including both official costs and informal costs (such as bribes to expedite transactions), partly by improving systems for land registration and management of land records; Critically reassess land administration agencies and find ways to improve incentive structures, to reduce rent-seeking and base promotions on performance; Promote women's independent land rights through policy measures to increase women's bargaining power within the household and in society generally; Improve transparency of land administration and public access to information, to reduce rent-seeking by land administration officers and to strengthen poor people's land rights (and knowledge thereof); Strengthen institutions in civil society to provide the awareness, monitoring, and pressure needed for successful reform and to provide checks and balances on inappropriate uses of state power; In a companion paper (WPS 2124) the author addresses these issues at the level of a particular state - Orissa, one of India ' s poorest states - in an empirical study, from a transaction costs perspective, of social exclusion and land administration. This paper - a product of the Rural Development Sector Unit, South Asia Region - is part of a larger effort in the region to promote access to land and to foster more demand-driven and socially inclusive institutions in rural development.

The analysis shows that frequent shocks increase land market activity, an effect that is mitigated by the presence of safety nets and banks. Land sales markets improved productivity and helped purchasers, many of whom were formerly landless, to accumulate non-land assets and significantly enhance their welfare.

Spanning multiple cities and croplands, these corridors connect metropolises via high-speed superhighways in an effort to make certain strategic regions attractive destinations for private investment. As policy makers search for decentralized and market-oriented means for the transfer of land from agrarian constituencies to infrastructural promoters and urban developers, the reallocation of property control is erupting into volatile land-based social conflicts. In Shareholder Cities, Sai Balakrishnan argues that some of India's most decisive conflicts over its urban future will unfold in the regions along the new economic corridors where electorally strong agrarian propertied classes directly encounter financially powerful incoming urban firms. Balakrishnan focuses on the first economic corridor, the Mumbai-Pune Expressway, and the construction of three new cities along it. The book derives its title from a current mode of resolving agrarian-urban conflicts in which agrarian landowners are being transformed into shareholders in the corridor cities, and the distributional implications of these new land transformations. Shifting the focus of the study of India's contemporary urbanization away from megacities to these in-between corridor regions, Balakrishnan explores the production of uneven urban development that unsettles older histories of agrarian capitalism and the emergence of agrarian propertied classes as protagonists in the making of urban real estate markets. Book excerpt: This book examines how property rights are linked to socio-economic progress and development. It also provides a theoretical analysis, an economic/social analysis of planning, case studies of the implementation of planning and regulation instruments, practices related to law and planning, analysis of case laws in a particular segment. The interconnection between property, law and planning is a running theme throughout the book. The land question has been central to South Asian development on two counts: First, although the majority of the population relies on agriculture and allied activities their livelihood, landholding is highly skewed; second, urban planning is facing unprecedented challenges due to bourgeoning property values as well as gush of migrants to cities seeking livelihood. The response to these challenges in the form of laws and policies has been very large compared to the academic attention that is received. However, the measures emerging from planning and policies have had limited impact on the extent of the problems. This paradox calls for serious introspection and academic engagement that this book undertakes. The book further deals with the emerging discipline of planning law, which determines property value and use, and argues that regulatory issues of public policy determine the property valuation and property pricing.
