En France, ce concept fut introduit dans le Code de l’aviation civile par la loi n° 96-151 du 26 février 1996. L’« agent habilité » est une personne morale de droit privé agréée par les autorités compétentes afin de procéder aux contrôles de sûreté pour empêcher que des armes, des explosifs ou tout autre engin, articles ou substances dangereux ne soient introduits à bord d’un aéronef et utilisés pour commettre un acte d’intervention illicite. Le fondement juridique et l’objet de l’intervention de l’« agent habilité » permettent d’identifier une mission de service public administratif en matière de sûreté aéroportuaire. L’« agent habilité » est en effet une personne morale de droit privé intervenant dans l’action administrative, et plus précisément en matière de police administrative. L’intervention en matière de sûreté place ainsi un acteur de droit privé à mi-chemin entre le droit privé et le droit public sans modifier la nature privée du statut de l’entité agréée. Par ailleurs, sachant que l’exercice effectif de prérogatives de puissance publique joue un rôle fonctionnel dans la détermination de la compétence juridictionnelle et du régime de responsabilité, et que le certificat de sûreté émis par l’« agent habilité » à la suite de son intervention est un acte qui en traduit la mise en oeuvre effective, la responsabilité civile des suites dommageables de l’existence d’un colis piégé à l’origine de l’explosion d’un aéronef préalablement contrôlé par un « agent habilité » et accompagné d’un certificat de sûreté émis par ses soins est, comme il l’est démontré dans ces travaux de recherche, de nature administrative et extracontractuelle. La responsabilité pénale de l’« agent habilité » peut elle aussi être engagée sur le fondement d’infractions visées au Code pénal, lorsqu’elles sont commises pour son compte par un de ses organes ou représentants."
