Dès lors, il est nécessaire d'élaborer un statut juridique suffisamment protecteur dans une perspective de développement durable.Pour ce faire, cette étude tente de résoudre les lacunes du droit de l'eau d'une part, en vérifiant l'utilité des outils juridiques existants à la disposition des dépositaires et des gestionnaires de la ressource ; d'autre part, en envisageant de " nouveaux " instruments plus adaptés. Ainsi, sont effectuées plusieurs interventions sur l'organisation du service public de l'eau au niveau des droits internes, du droit international et communautaire, mais également sur la relation entre les acteurs publics et privés dont l'association donne lieu à des schémas de partenariat intéressants.

Ce sujet est d'abord appréhendé par son aspect historique pour ensuite entamer une étude prospective sur l'implication de la marchandisation de l'eau à travers la place importante prise par les firmes multinationales aidées en cela par les institutions financières internationales (FMI et Banque mondiale) et l'OMC.Les implications de ces accords internationaux sur les pays en voie de développement peuvent être dramatiques pour une majorité de la population. Ainsi, l'idée d'un droit international de l'eau au service de l'humanité peut s'avérer nécessaire car seul garde fou.C'est par la défense de la notion d'un droit de l'homme à l'eau et en apportant à l'eau la qualification de patrimoine commun de l'humanité que le concept de Bien commun pourrait trouver un début de concrétisation. Car l'enjeu est de contribuer à rendre effectif le droit à l'eau et plus particulièrement à l'eau potable comme faisant partie du droit à la vie (qui est le premier des droits dits civils et politiques).

Coastal ecosystems are highly vulnerable to alteration of their physical, chemical and biological characteristics (marine intrusion, acidification of marine environments, changes in ecosystems, evolution and artificialization of the coastline, etc.).In contact with heavily populated areas, these environments are often the receptacle of a lot of chemical and biological pollution sources that significantly diminish their resilience. In this context of accelerated evolution and degradation of these areas important for food security of many populations around the world, it is necessary to better identify the factors of pressure and understand, at different scales of observation, their effects and impacts on the biodiversity and on the socio-eco-systems, in order to determine the degree of vulnerability of these coastal ecosystems and the risks they face. A transdisciplinary and integrated approach is required to prevent risks. Within this framework, operational coastal oceanography occupies an important place but also the implementation of a true socio-eco-system approach in order to set up an environmentally friendly development.
