This book was released on 2020-12-07 with total page 380 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides answers to the following questions: how do traditional principles of private international law relate to the requirements of the internal market for the realisation of the EU’s objectives regarding the protection of weaker parties such as consumers and employees? When and how should private international law ensure the applicability of EU directives concerning the protection of weaker parties? Are the EU’s current private international law, rules on conflict of laws, and private international law approach sufficient to ensure the realisation of its objectives regarding weaker contracting parties, or is a different approach to private international law called for? The book concludes with several proposed amendments, mainly regarding the Rome I Regulation on the law applicable to contractual obligations, as well as suggestions on the EU’s current approach to private international law. This book is primarily intended for an academic audience and to help achieve better regulation in the future. It also seeks to dispel certain lingering doubts regarding the current practice of EU private international law.

It unifies the conflicts of laws, jurisdiction and recognition of foreign judgments and some other legal instruments in the field of succession and wills. This volume provides an article-by-article commentary on the individual provisions of the Regulation, introduced by an overview of its general framework and underlying principles. As a reference tool for the Regulation, this book is intended to promote a high standard of interpretation and application. With contributions from leading scholars in the field, it uses a comparative approach in its analysis to enrich the academic debate and highlight the problems likely to arise in the practical application of the Regulation.

Available in PDF, EPUB and Kindle. Book excerpt: It has now been almost two years since the Treaty of Lisbon took effect. The time was characterized by an intensive and controversial discussion between the European Union (EU) institutions and member states on the setup of arguably the most important institutional innovation besides the new post of the High Representative of the Union for Foreign Affairs and Security Policy (HR): the European External Action Service (EEAS).The EEAS has the purpose of serving its head, HR Ashton, in fulfilling her tasks of, inter alia, conducting the EU’s Common Foreign and Security Policy (CFSP) and increasing the efficiency and coherence of EU external relations. Regarding hither to the execution of EU foreign policy, the HR admitted in the run-up to the establishment of the EEAS that “the EU can be too slow, too cumbersome and too bureaucratic”1. With the setup of the new diplomatic service the EU wished to overcome occurring difficulties that result out of the complex net of responsibilities that characterise the external relations of the EU and thus ‘give the EU a stronger voice around the world, and greater impact on the ground’2.Given the fact that the EEAS constitutes a whole new de facto institution without predecessor and was therefore built from scratch,it is very interesting from a political scientist point of view to see where and how the new service is positioned in the institutional architecture of the EU system. Since the EEAS was ought to bring together rather intergovernmental (e.g. CFSP) and supranational (e.g. development cooperation) policy spheres of EU external action, a discussion on how it can be scrutinized by grand theories of European integration seems to offer valuable insights. In section 2 this research paper first takes a deeper look at two of the most influential grand theories of European integration, neofunctionalism and intergovernmentalism. Basic assumptions and logics of the two approaches will be used to build indicators with which the overall research question of the analysis will be assessed: ¿can the two grand theories explain the institutional setup of the newly established EEAS? The empirical examination of the topic, which will mainly be based on the relevant treaty provisions and the existing decisions and reports of the EU institutions on the EEAS, follows in section 3 of the paper. Furthermore, findings of various academic articles that dealt with the EEAS in the last two years are taken into account. A conclusion summarizes the results of the analysis in section 4.

This new volume presents all of the state of the art thinking, focusing particularly on international relations theory and theoretical debates in Western and Central European countries. The contributors seek to strengthen knowledge about different ways of cultivating the discipline; to intensify pan-European communication concerning IR theory; to contribute to improving the quality of theorizing; and finally to consider future directions for the discipline in Europe. The main issues addressed include: the historical development of the discipline; factors driving IR theorizing; the institutional and cultural context of theorizing; 'homegrown' theory-building vs. theory import; patterns of traditional and new discourse; and the diversity of disciplinary traditions.

Book excerpt: Latin America–European Union relations in the twenty-first century provides a valuable overview of transatlantic trade agreement negotiations and developments in the first decades of the twenty-first century. This edited collection examines key motivations behind trade agreements, traces the evolution of negotiations and explores some of the initial impacts of new generation trade agreements with the EU on South American countries. The book makes an important contribution to our understanding of relations between these regions by contextualising relations and trade agendas, both in terms of domestic political and economic policies and broader global trends. It demonstrates the importance of a shift toward mega-regional trade agreements in the 2010s, particularly under the Obama administration in the United States, in shaping South American and European agendas for trade agreement negotiations and their outcomes. Detailed case studies in the book investigate EU relations and negotiations with countries that have successfully negotiated new generation trade agreements with the EU: Mercosur, the Andean states, Chile and Mexico. Other contributions offer a wider overview of EU-Latin American relations, including parliamentary and civil society relations. The net result is a balanced analysis of contemporary EU relations with South America, useful for students and scholars of foreign policy and political economy in both regions.

It aims at a better understanding of the European Union through the actions, contributions, and ideas of these outstanding characters to European integration and disintegration. By doing so, the book offers an entirely new perspective, presenting the actions of the main actors involved, their background, their historical time, their challenges and problems, and how they influenced the European Union's development. The authors in detail discuss different ideas connected to leaders, such as Jean Monnet and neo-functionalism, Spinelli and federalism or Churchill and the idea of cooperation. Furthermore, the book examines major policies and events, like the Common Agricultural Policy, the creation of the Euro as a consequence of the German reunification and Mitterrand’s reactions, or Brexit and its connection to the impact of Margaret Thatcher. The global essence of the book makes it a must-read for students, researchers, and scholars interested in a better understanding of the European Union's integration process.

This book was released on 2010 with total page 218 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is devoted to the study of the Europeanization of Spanish administrative law, and its scope results, therefore, from the intersection of two basic notions. On the one hand, Europeanization is understood here as a top-down process of innovation suffered by national law as an outcome of the structural principles which govern the relations between European and national systems. On the other hand, the book focuses on some of the most important institutions of Spanish general administrative law, in order to give a wide and comprehensive insight into the transformations of the system, thus going beyond the description of the transformations experienced by the regulation of concrete sectors of administrative action. Specifically, the main topics discussed include regulation of administrative procedure, case law on the right to good administration, public procurement law, public services regulation, interim measures in judicial review, and the evolution of administrative sanctions.
