Nella struttura del nuovo codice è stato impiantato il procedimento unitario: il “contenitore” processuale unico nel quale confluiscono tutte le domande di regolazione per via giudiziale della crisi e dell’insolvenza. Questa struttura ha determinato la necessità di dissociare, nella sequenza delle disposizioni, talune regole del processo da altre regole volte a disciplinare i diritti (sostanziali) delle parti: nell’opera sono trattati trasversalmente i profili di diritto processuale, per offrire al lettore un primo inquadramento del sistema del codice. Alcune parti del codice sono in continuità con il passato, mentre altre sono assai innovative: in quest’ottica, le indicazioni giurisprudenziali fornite sono relative sia alle prime esperienze pratiche applicative della nuova disciplina che agli indirizzi interpretativi che potranno trovare continuità. L’opera, quindi, non è solo una ricostruzione teorica ma offre al professionista anche gli strumenti pratici per interpretare la nuova disciplina alla luce delle prime pronunce giurisprudenziali.

A debate on the most appropriate way to enforce competition rules, in light of the crisis, is definitely useful. A "relaxed" stance to competition during difficult periods may be tempting and indeed, this has often been the approach used in the past. However, the enforcement of competition rules is no less important during times of crisis than during normal periods. It has also been argued that, when public resources are stretched to the limit and businesses are struggling to survive, competition authorities should seek to focus their limited resources on those anticompetitive practices which are most detrimental to consumer welfare such as cartels. Indeed, if over-enforcement is perhaps undesirable when the economy is functioning well, it will inevitably become more problematic during an economic downturn. In addition, business managers may be increasingly tempted to resort to anticompetitive practices when faced with economic hardship. Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.
