Ce lent processus de territorialisation a abouti à un système d'action publique complexe dans le champ de l'habitat, où s'enchevêtrent les compétences de chacun des échelons publics. Au sein de cet éclatement de la responsabilité publique dans le domaine du logement, l'échelon intercommunal (soit les Etablissements de coopération intercommunale-EPCI) s'est vu confier par le législateur le rôle de "chef de file" des politiques de l'habitat sur les scènes locales du logement. La thèse se propose d'analyser le processus d'apprentissage à l'oeuvre dans l'élaboration et la mise en oeuvre de ces politiques locales de l'habitat, au sein d'un contexte d'incertitude généralisée qui caractérise aujourd'hui l'action publique en général, et l'action urbaine en particulier. Elle s'appuie sur un travail empirique mené au sein de deux configurations locales bénéficiant d'une ancienneté dans leur pratique de la coopération intercommunale, et d'une certaine maturité dans la prise en charge des questions d'habitat par l'action locale : les agglomérations de Lyon et de Dunkerque. La thèse interroge d'abord le rôle de l'Etat dans son apprentissage des nouvelles responsabilités des EPCI. Elle montre notamment que cet apprentissage est source d'incertitudes pour les acteurs intercommunaux, l'Etat étant plus souvent perçu comme un perturbateur qu'un facilitateur. Elle décrit également la fragilisation des services déconcentrés de l'Etat qui semble s'opérer dans le champ de l'habitat. La thèse s'intéresse ensuite à l'apprentissage des EPCI et notamment aux ressources dont les intercommunalités disposent pour élaborer et mettre en oeuvre leurs politiques locales de l'habitat, ainsi qu'aux moyens qu'elles mobilisent pour contourner le déficit coercitif de ces ressources (pédagogie, technicisation, contractualisation). Enfin, elle revient sur les avancées et les limites de ce double processus d'apprentissage. Elle montre que les notions de temps et de confiance sont au coeur des processus observés et propose des pistes de réflexions.

The French "right to housing" offers poor and disadvantaged citizens priority in social housing allocation, and even a legal action against the State to obtain a social home. Despite this, France is suffering a long-lasting housing crisis with disadvantaged people having particular difficulties of access, often despite the efforts of local housing actors. This situation is affected by the European Court of Human Rights and EU decisions limiting diverse national housing and rental policies. Between historic French revolutions and the modern riots, negotiated solutions to social dilemmas emerged. Despite progress in constitutional principles, complex local negotiations still ultimately determine who is housed. Local social landlords, mayors and employee and tenant representatives use their privileges to house their insiders: existing tenants, locals and employees, with rent insufficiently subsidized. ‘Insider Outsider’ theory is used for an economic analysis of exclusion in social housing allocation: its processes, institutional context, and stigmatizing effects. This highlights the spatial effects of nimbyism, excluding disadvantaged outsiders, and concentrating them in deprived areas. Simultaneously, urban regeneration reduced affordable housing stock and ‘social mix’ became a reason to refuse a social home. History, comparative law, economic theory and local interviews with housing actors give a detailed picture of what happens in and around French social housing allocation for an interdisciplinary housing policy audience. Constitutional principles appear in an unfamiliar guise as negotiating positions, with the "right to property" supporting landlords and the "right to housing" supporting tenants. French debates about the function of social landlords are echoed across Europe and reflected in European policies concerning rights, and the exclusion of disadvantaged minorities.

À travers un plan à la fois chronologique et par échelles comprenant l'étude de différents programmes d'habitat, cette thèse vise à répondre à la question suivante: au-delà de la vision néolibérale imposée dans les programmes financés par l'aide internationale, les principes de privatisation, de décentralisation et de participation peuvent-ils, à travers l'appropriation qui en est faite par les acteurs locaux -qu'ils soient publics (nationaux ou municipaux), privés ou membres de la « société civil » -apporter des réponses novatrices, efficaces et « justes» aux problèmes d'habitat et de développement urbain ?

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011).
