La pena es mayor si el injusto es doloso que si es imprudente porque nuestros Códigos Penales parten de que el primero es más grave. Este es el punto de partida del presente trabajo. Esto es así, se defiende a lo largo de la obra, porque el injusto imprudente es siempre un supuesto de error. La imprudencia es siempre un error de tipo. A pesar de ello, el hecho se imputa al agente no por causa de su error, sino a pesar de su error. El error no exime de responsabilidad porque está vinculado a una conducta contraria a deber y, por ello, la conducta es antijurídica. En realidad, tal error puede versar sobre los elementos que configuran el hecho típico (en los delitos puros de resultado un error sobre el riesgo típico o en los delitos con elementos normativos un error sobre la normativa extrapenal) pero también sobre los presupuestos que habilitan que la actuación sea conforme a Derecho (por ejemplo, creencia errónea sobre el hecho de ser víctima de una agresión delictiva). El error es una falta de correspondencia entre lo abarcado por la consciencia y la realidad. No hace falta que el sujeto tenga una representación alternativa de la realidad, sino simplemente que no se represente alguna circunstancia relevante desde el punto de vista del tipo correspondiente. Todo error de tipo es, a su vez, un error de prohibición o mandato, por lo cual el delincuente imprudente nunca conoce la disconformidad de su conducta con respecto a lo prescrito por la norma. Book excerpt: Reassesses the philosophical and pedagogical contributions of Protagoras Protagoras and Logos brings together in a meaningful synthesis the contributions and rhetoric of the first and most famous of the Older Sophists, Protagoras of Abdera. Most accounts of Protagoras rely on the somewhat hostile reports of Plato and Aristotle. By focusing on Protagoras's own surviving words, this study corrects many long-standing misinterpretations and presents significant facts: Protagoras was a first-rate philosophical thinker who positively influenced the theories of Plato and Aristotle, and Protagoras pioneered the study of language and was the first theorist of rhetoric. In addition to illustrating valuable methods of translating and reading fifth-century B.C.E. Greek passages, the book marshals evidence for the important philological conclusion that the Greek word translated as rhetoric was a coinage by Plato in the early fourth century. In this second edition, Edward Schiappa reassesses the philosophical and pedagogical contributions of Protagoras. Schiappa argues that traditional accounts of Protagoras are hampered by mistaken assumptions about the Sophists and the teaching of the art of rhetoric in the fifth century. He shows that, contrary to tradition, the so-called Older Sophists investigated and taught the skills of logos, which is closer to modern conceptions of critical reasoning than of persuasive oratory. Schiappa also offers interpretations for each of Protagoras's major surviving fragments and examines Protagoras's contributions to the theory and practice of Greek education, politics, and philosophy. In a new afterword Schiappa addresses historiographical issues that have occupied scholars in rhetorical studies over the past ten years, and throughout the study he provides references to scholarship from the last decade that has refined his views on Protagoras and other Sophists.

From affirmative action to protection against sexual harassment, from indigenous peoples’ rights to gay marriage, the struggle to eliminate subordination or exclusion and to achieve substantive equality has been waged through courts and legislation. At the same time, critiques of legalism have generally come to be regarded by liberal and left reformers as politically irrelevant at best, politically disunifying and disorienting at worst. This conjunction of a turn toward left legalism with a turn away from critique has hardened an intellectually defensive, brittle, and unreflective left sensibility at a moment when precisely the opposite is needed. Certainly, the left can engage strategically with the law, but if it does not also track the effects of this engagement—effects that often exceed or even redound against its explicit aims—it will unwittingly foster political institutions and doctrines strikingly at odds with its own values. Brown and Halley have assembled essays from diverse contributors—law professors, philosophers, political theorists, and literary critics—united chiefly by their willingness to think critically from the left about left legal projects. The essays themselves vary by topic, by theoretical approach, and by conclusion. While some contributors attempt to rework particular left legal projects, others insist upon abandoning or replacing those projects. Still others leave open the question of what is to be done as they devote their critical attention to understanding what we are doing.
