Alors qu'il n'a nullement vocation à préserver les " concurrents ", mais la " concurrence ", le contentieux objectif (ou Public Enforcement), organisé devant les autorités française et communautaire de concurrence, emporte depuis longtemps la faveur des opérateurs lésés par une entente ou un abus de position dominante. Malgré les droits subjectifs qu'ils tirent de l'effet direct des articles 101 et 102 TFUE, les agents économiques renoncent très souvent à s'en prévaloir devant les juridictions nationales. Le constat n'est, certes, pas nouveau. La révolution juridique et culturelle engendrée par le règlement n° 1/2003 s'est, cependant, incidemment accompagnée d'une évolution de la situation des victimes dans le contentieux objectif où la dimension négociée des procédures a gagné en acuité. Son onde de choc pourrait également frapper le contentieux subjectif (ou Pr/vote Enforcement) jusqu'alors stigmatisé par son "sous-développement ". L'effectivité de la préservation des droits individuels concourt à la lutte contre les pratiques anticoncurrentielles, l'indemnisation des victimes pouvant potentiellement développer des effets dissuasifs et, parfois même punitifs sur les contrevenants. Hier esseulé et " surmené ", aujourd'hui érigé au rang de véritable acteur et allié des autorités publiques, l'opérateur lésé paraît aujourd'hui au coeur des sollicitudes. Cette étude propose d'appréhender - pour la dépasser - cette situation paradoxale par la recherche de l'aptitude de chacun des contentieux à protéger les intérêts particuliers des agents économiques. Pour y parvenir, elle recense, tout d'abord, l'ensemble des garanties procédurales attribuées aux opérateurs lésés dans les procédures mises en oeuvre devant les autorités de concurrence, afin de vérifier leur capacité à permettre la défense effective de leurs intérêts. Puis, elle invite à constater - pour tenter d'y remédier - les carences du contentieux subjectif Les pistes de réflexions tendant au développement des actions privées sont multiples et ne manquent pas de nourrir un certain débat autour de la rencontre du droit de la concurrence - matière entièrement irriguée par le raisonnement économique - et du droit de la responsabilité dont les principes s'accommodent difficilement des spécificités de la matière économique.

For the past decade, academic publications have focused on the proposal for a Directive on damages actions, then the Directive 2014/104/EU of 26 November 2014 itself, and finally the transposition texts. However, this understandable interest should not lead to overlook the fact that the Directive has been applied very little until now. This is mainly due to its application ratione temporis. In addition to the fact that Member States only transposed the Directive between the end of 2016 and 2018, Article 22 of the Directive provides that the substantive rules contained in the Directive cannot be applied to infringements subsequent to the national laws transposing them, while the procedural rules of the Directive apply to proceedings commenced on or after 26 December 2014. Thus, it is prior domestic law that continues to govern the vast majority of cases before national courts in the “Pre-Directive era.” In addition, a number of issues of the utmost importance have not been addressed by the Directive, such as questions of international jurisdiction or the quantification of “interests.” For these reasons, it seemed necessary not to limit this book to commenting on the Directive, important as it is, but to go beyond it.
