Le développement exponentiel des technologies nouvelles de l'information et des échanges numériques ont amené le législateur a œuvré dans le sens d'une adaptation du droit de la preuve aux technologies nouvelles de l'information. C'est dans ces conditions que la loi du 13 mars 2000 a consacré la fin du monopole du support papier dans la hiérarchie des preuves en reconnaissant à l'écrit et à la signature électronique une force probante équivalente. La loi du 21 juin 2004 pour la confiance dans l'économie numérique a renforcé cette consécration en admettant que lorsqu'un écrit est exigé pour la validité d'un acte juridique, celui-ci peut être établi et conservé sous forme électronique. Toutefois, cette reconnaissance juridique ne pouvait valablement intervenir sans que le législateur impose un certain nombre de garanties. La signature électronique en est devenue le gage.

Since the thirteenth century, the signature has been used to demonstrate proof of intent. This book puts the concept of the signature into a broad legal context, setting out the purposes and functions of a signature. Drawing on cases from common law jurisdictions across the world, this book demonstrates that judges expanded the meaning of the signature as technologies developed and were used in unanticipated ways. Following an overview of the historical methods used to demonstrate proof of intent and authentication, the book considers the judicial response to the variations in form that signatures have been subject to over the past two hundred years, from initials, partial signatures, and fingerprints to rubber stamps and typewriting. Past judicial decision-making not only demonstrates the flexibility of the form a signature can take but also confirms that judges had the flexibility of mind to accept the first forms of electronic signature (telex, facsimile transmission) without the aid of special legislation. In this way, the signature is a prime example of the inherent flexibility of the English common law.

La réitération est un mécanisme par lequel des sujets de droit manifestent à nouveau leur volonté pour déclencher les effets juridiques qui y sont attachés. Il convient dès lors de distinguer la réitération de notions proches, telles la répétition, le renouvellement ou encore la confirmation. En s'appuyant sur les critères jurisprudentiels de l'identité et de l'unité des actes successifs, deux figures de la réitération doivent être identifiées: la réitération du consentement et la réitération du contrat, c'est-à-dire de l'accord de volontés. L'intérêt pratique de cette technique est alors double: geler les effets d'un consentement pour permettre à son auteur de continuer à réfléchir avant d'émettre une décision définitive; geler les effets d'un contrat pour servir les intérêts des parties jusqu'à la signature de l'acte définitif. La réitération s'impose alors comme une notion fondamentale répondant à des enjeux contemporains majeurs: protection du consentement. technique de formation du contrat par étapes, procédé de découpage de la période de formation du contrat et de celle de son exécution, protection de la force obligatoire de la parole, protection de l'intégrité du corps humain, conciliation d'intérêts divergents. La pleine efficacité de la réitération passe cependant par une prise de conscience collective de certaines réformes à entreprendre en termes de régime juridique.
