C'est ainsi que Dominique Joseph Garat, député de la Constituante, s'était exclamé devant la représentation nationale pour affirmer son opposition concernant l'idée d'une irresponsabilité du mineur fondée sur le discernement. Cette insurrection ne sera pas la seule, bien au contraire. En effet, la question de l'enfance délinquante n'a cessé de revenir dans le débat public, et même très récemment avec l'ordonnance n°2019-950 du 11 septembre 2019 portant partie législative du code de la justice pénale des mineurs. Le législateur, la jurisprudence et la doctrine se sont toujours efforcés depuis le début de l'époque contemporaine de construire un régime juridique propre à l'enfant, se fondant notamment sur les notions de « âge » et de « discernement ». Toutefois, la préoccupation de la société quant à sa responsabilité civile et pénale n'est pas récente : le statut juridique de l'enfant a fait l'objet, tout au long de l'histoire, d'aménagements spécifiques et différents de celui du majeur. Du droit romain à l'ordonnance de 1945, en passant notamment par le droit canonique et de l'Ancien Régime, l'évolution de la responsabilité de celui dont la raison n'est pas encore pleinement développée apparaît certes intéressante mais surtout indispensable dans la compréhension de l'esprit des règles qui lui sont aujourd'hui applicables. En ce sens, la présente thèse traitera pleinement et chronologiquement de cette évolution.

La conclusion qui s'est imposée, au terme de cette confrontation entre spécialistes de plusieurs disciplines, est que la technique juridique, nécessaire en tout état de cause, est encore impuissante à garantir pleinement ce qu'on doit appeler, plus que jamais, le respect dû à l'enfant.

Acteur principal de la protection de l'enfance, le juge des enfants voit ses attributions se situer aux confins du droit civil et du droit pénal. Il convient alors de s'interroger sur son rôle, en constante évolution depuis sa création en1945. Entre protection et répression, il est particulier pour le juge des enfants de situer son intervention. Tout en assurant la protection de l'enfant, ce magistrat doit respecter les principes de procédure qui régissent notre droit français. Le contradictoire, un des principes directeurs, apparaît ainsi comme incontournable dans le quotidien du juge des enfants. Toutefois, si la nécessité du respect de ce principe n'est pas à contester, sa définition est parfois imprécise dans les textes, et son application rend la protection de l'enfant compliquée. C'est ainsi qu'au quotidien, le magistrat de la jeunesse se doit de trouver un compromis entre le respect du contradictoire et la protection. Cet exercice nous conduit ainsi à mettre en exergue que l'application du contradictoire est particulière lorsqu'il est pris en compte devant le juge des enfants. Définition imprécise, application spécifique, le sujet relatif à la mise en œuvre d'un principe de procédure devant le juge des enfants paraît bien complexe. Néanmoins, c'est de cet aspect que découle tout son intérêt.

Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. They produced a legal code (which they called the Salic law) at approximately the same time that the Visigoths and Burgundians produced theirs, but the Frankish code is the least Romanized and most Germanic of the three. Unlike Roman law, this code does not emphasize marriage and the family, inheritance, gifts, and contracts; rather, Lex Salica is largely devoted to establishing fixed monetary or other penalties for a wide variety of damaging acts such as "killing women and children," "striking a man on the head so that the brain shows," or "skinning a dead horse without the consent of its owner." An important resource for students and scholars of medieval and legal history, made available once again in Katherine Fischer Drew's expert translation, the code contains much information on Frankish judicial procedure. Drew has here rendered into readable English the Pactus Legis Salicae, generally believed to have been issued by the Frankish King Clovis in the early sixth century and modified by his sons and grandson, Childbert I, Chlotar I, and Chilperic I. In addition, she provides a translation of the Lex Salica Karolina, the code as corrected and reissued some three centuries later by Charlemagne.
